ebay dispute...item misreprented, should I have to pay for return shipping?

I recently ordered a cell phone battery for $6. I ordered the OEM battery and he shipped a different one. The auction says that there is a $9.99 fee for returns. It didn't occur to me that he would send me the wrong battery.
I emailed him and told him what happened and that I wouldn't be returning it and paying the fee. I told him that he could send me the right battery and get a positive or ignore me and get a negative. He emailed right away and said he'd send the right battery. It hasn't come yet. I won't pay to send the battery back but this is only a $6 deal.

update:
Seller found this link written by another ebay SELLER, oddly the 8 chip low density ram mentioned is not listed in any of his current auctions. LINK

The seller changed my original auction saying he had this link in it already 🙂 He wants to extend $5 to cover my $8 shipping and time IF I edit my review.

I don't think he read this article right...however, it's ambiguous at times as low density in a PC100 chip is different than PC2100/etc...however; it was written by a seller rather than just a third party and later this has been dubunked on thinkpad forums...

Right there in that article it's clear:
"In the 256MB category you have 2 types of chips you can use. The first one has 16Mx16 worth of memory - this is the high density chip. The low density chip only has half that much memory on it - 16Mx8. This is why you only need 8 chips on a high density stick of 256MB and you need 16 chips on a low density stick of 256MB."

He does go on to describe an odd chip he did have that had strange looking bumps...I could not find a picture of what he was talking about but you can check his current auctions and he is clear the 16 chip ones are low density in PC100 and the 8 chips are not.  He is not offering any 8 chips at low density in the PC100 range.

There is much write up here: http://forum.thinkpads.com/viewtopic.php?t=68523 stating how there really is no PC100 256MB low density chips with less than 16 chips.

What some sellers have done is modify high density 512MB sodimms.

this is a more scientific write up: http://www.kawakami-ca.com/8_c..._density_256mb_sodimm/

I am eating the $8 and time, and leaving my feedback up.
