Ebay dispute... Advice?

So I bought an electric guitar on ebay. It was listed as being in good condition and the auction stated that there was nothing wrong with it. when I received the item, I found out that there is a lot wrong with it. Rusted bridge(needs replacement or thorough rust removal most likely), suspect humbuckers, inaccurate sound, etc.


I quickly contacted the seller and offered her two options. Either she refunds me the price of repairs or I ship back at her expense.

She replied by saying that she was selling the guitar for her boyfriend, and he says it was "playing just fine when he used it". she also mentioned that the guitar was being sold "as-is" when in fact the auction didn't say so. she further added that I "got off easy" because the shipping was $25 when in fact it actually cost her $40 to ship the item. (I cant see how that is my problem)

She offered to refund the price of the guitar back to me minus the shipping that I will have to pay for....

What would you do in my situation?

You don't really have an option besides refund + you pay to return it.

Can the seller retaliate with bad feedback as well? And if so, why? Doesn't this prevent a buyer from leaving honest feedback?

Basically it will cost me about as much to repair this thing as it would cost me to ship it back.

Well, that's up to you as to whether it's worth the money to repair vs. worth the money to send back. Personally I'd send it back, but, that's your call.

Sellers can't leave negative feedback anymore for precisely the reason you state. Unfortunately, it also prevents sellers from warning people about scammers and idiots.

I'd file a PayPal claim, wait until you win, then ship the seller back a brick. It's much easier to scam people on eBay as a buyer than a seller!

From what I remember, sellers cannot leave anything but positive feedback for buyers. So regardless of what happens, you will either receive NO feedback or positive feedback.

You, on the other hand, should be able to do pos/neu/neg feedback.

Someone correct me if I'm wrong.

I would file a PayPal dispute, I think you have enough evidence to win it. Maybe you could get PayPal to also have seller cover shipping costs since it was misrepresented.
