ebay definition of brand new

Yup and you will still get the money back, long as the tracking showed it was delivered to the seller.

Seriously, I have heard some real horror stories about buyers who file significantly not as described with ebay and ebay automatically sides with the buyer. Well the buyer will send an envelope or empty box back with tracking on it and when ebay sees that the seller received it from the tracking give the buyer the money back while the buyer keeps the item too.

So the seller not only lost the money from the sale, but also the item, oh and to top it off they still have to pay the ebay fees cause it was their fault for not describing the item properly. I am not making this up, this shit has actually happened......

Update: Ebay sided with the seller because of the "battery option" statement which is also on the site. How in the world can ebay accept that brand new includes opened?

you can sell something as 'new' even without the packaging. what you were looking for was a 'brand new, sealed' item.

yea i mean based on her description of the item, i would see no reason at all to assume it isn't brand new in original packaging.

I bought a " mint" mmats amp off ebay. Apparently " mint" means freshly rattle canned with a few paint runs. The inside of the box smelled like a paint booth and the thing was still tacky.

Based on the manual, it's not just a set of AA's that you throw into the box. It's a proprietary battery.

Maybe I'm blind, but I don't see where in the manual it says the battery is an option. Actually, they make it quite clear in the manual that the battery is in the box. I don't know how the eBay rep can say it's not part of the package.

The situation sucks, but if eBay has ruled in their favour, all you can do is dispute it.

I believe the battery backup is really only for if you're using it for the cable company VoIP service. (will give you network even in the event of a power outage). If you're using this, then I'd suggest perhaps plugging your modem into a UPS so you can still use your phone during a power outage.

Update 3: CU responded again with this:
Thank you for your response to this case. We appreciate your patience
and understanding in this matter.

I did some research on Motorola.com and it turns out the battery the
manufacterer mentions is internal and not removeable. The battery is
there, but it only functions to save settings when its unplugged, not to
power the device. it turns out that the item was as described, but I can
understand how that could be confusing. Replacing or removing the
battery would require the disassembly of the unit which would violate
the warranty. I hope this helps. Thanks.

Is there any way I can report these CUs for negligence?

It is rather amusing to find out those advertisements are blatant lies. Like you said, it's obvious they haven't done shit and simply don't want take any losses on your transaction. You can try filing a complaint, but nothing will happen. At this point, I think you should tally it up to lesson learned and stop using shitbay.

this is typical ebay bs, they just want transactions to occur so they can make money and if you dont like it they want you to go away. stop using them and then vote against whitman for president, if you live in california. their customer nonservice is laughing at you

it isnt incompetence. they do this type of thing all the time. they send you meaningless emails in hopes that you will get so frustrated that you will just give up. why should ebay help you just so they can lose out on a sale? instead of wasting your time and getting worked up about this, you should cut your losses, forget about it and stop using ebay, that is what i did 10 years ago
