EBay deal gone bad - want your opinion

Situation: I purchased a subwoofer on EBay. The description said "Unused sub in open box. Factory packaging is tattered."

Upon receiving the sub, the factory box was indeed all taped together, but the sub appeared to be perfect; never been mounted.

Upon inspection, I discovered that the frame was chipped.

*edit* I should add that this wasn't a private seller, but a big "business." He's got tons of them.

That isn't necessarily a problem...but I continued to inspect. The cone was frozen in place. No up/down motion AT ALL.

I hooked it up to an amp, just to check. You can barely hear anything; but it sounds like a bee trapped in a can. No cone movement. This sub is a paperweight! :|

The proposed resolution

Here's what I emailed the seller, along with more pics. I think my offer is MORE THAN FAIR. What do you think? Vote!

I received the sub today (EBay Item# xxxxxxxx). Upon inspecting it, I discovered that the frame is chipped. See pictures. This immediately got me curious as to the condition of the sub as a whole. Though the sub appears to have not been mounted, it does NOT work.

The motor assembly is frozen in place; the cone does not move at all. I hooked it up to an amp and got the expected results; nothing. Well, you can hear a slight buzzing noise that sounds like a bee trapped in a can, but that's it.

I have had literally tens of subs over the years; I can say with all assurance that this sub is dead. A paperweight.

Though the item is as described: "Open/Tattered Box." The description says nothing about it being defective.

I'd like to give you a chance to make this right; I don't want my money back, I want the sub.

I will ship the dead one back to you and pay the shipping. If you could send me an exact replacement and pay the shipping to me, I would say that is fair. I'm not happy to be paying shipping TWICE, but, I think the resolution I just described is fair.

It seems fair to me, a hopeless Goody Two-Shoes.

If the auction says "as-is" you're probably out of luck though, unless they happen to be as insufferably ethical as I am 🙂

See, the thing though is that if I say "Send me a new one, this one is dead" the seller would have to be a real fool to take me up on it.

Though my feedbacks/score speaks for itself, and I am a Verified PayPal member, you still really can't trust anyone these days.

I figured by me offering to pay the shipping back, he'd be more inclined to say "OK."

I only emailed him an hour ago. Gotta give him a day or two to get back to me. I am off from work tomorrow though; it would be a perfect time for me to get the box to the FEDEX place.
 
If he doesn't have a new one he's not going to go out and buy a new one just to ship it to you at his loss. Probably the best you can hope for in this situation is a full refund (plus or minus the shipping back to him). He owes you a refund, not a brand new sub.

Nope. Didn't say as is. Says:

Item is UNUSED in open factory packaging, packaging is tattered.

They DO have a disclaimer that says:

Sellers warranty DOES NOT cover:

Items sold in as-is condition

Buyers inability to install and/or use equipment due to lack of knowledge or experience.

But this item was NOT advertised as as-is.

DITTO. he's a moron, a scammer, or the post office decided to have a party with ur sub. Either way, he owes you $. Why would you want to risk another item from him?
 
You were had, sold "AS IS". Most likely you used buy it now with low price and high shipping. There are a lot of people that sell junk, and only junk on there.

AND the seller has TONS of new ones. I bid on this one b/c of the description and the fact that I actually paid about $50 less than a new one in an undamaged box goes for.

Still, it was not sold as-is, AND it WAS SOLD AS UNUSED.

Sorry, you're incorrect. The item was NOT sold as-is. It was sold as UNUSED (that means new) in tattered factory packaging.
 
This depends who sold it, a "business" or a private seller. If this is a "business" IDK. However if its a private seller and the price difference between a new subwoofer and the one you bought is large. Asking for a replacement product is a bit much cause you do not know the circumstances of how he got it. Have him pay for return shipping and give you your money back.
