EDIT: No..that was just a comment from me when i was ridicously pissed after reading his last reply. But he is going to get a negative feedback from me though.

I am removing all email correspondences from this thread, just to be on the safe side.

he already has a negative feedback from somebody else about the same thing and you only took 3 business days. This guy is an complete ahole, do youmind if I messag ehim telling him that he is being way too up tight and eBay/internet purchasing is not fo rhim if he cant wait 3-4 days.

However, he is a lawyer. So please, don't do that. Also, while I certainly think it would be enjoyable to ask his employer if his behavior is representative of the firm, I wouldn't do it without contacting an attorney first. In fact, it would probably be better to leave your neg feedback, and have no further conatct with the guy. Instead, let the thread do its work, and I'm sure that someone will be nice enough to dig up his info on their own and email it to his work of their own volition, thus keeping you in the clear, right? 😀

no..that was just a comment in frustation. Not going to do that (definately not when the gas costs $3/gal...lol...he is ~60-70 miles from me)

i will leave a negative feedback for him if he leaves negative for me. I just want to talk with him and clear him up not to ever deal online ever again.

EDIT: all those people who quoted me...can you pls remove the comment that I made in frustation.

If he wants to leave me a negative feedback, let him. I dont care about him anymore...I have wasted enough of my time and energy trying to compromise with him but he apparently just wants to have it his way.

No, the item was not broken. And i guaranteed it against DOA. I have repeatedly offered him to send the phone back to me and I will offer him FULL refund (including shipping & handling) and he doesnt wants that either.
 
Let him leave you negative feedback. And of course do the same for him. His FB already has a negative, for the exact same situation. Don't worry about getting one negative, it'll be from an obvious jerk and buyers will ignore it, trust me. I am a Platinum Power Seller with 100% positive, and I know one day, I'll get a negative from a jerk. It happens, don't worry about, don't let it get you down, because it will have no bearing on your future sales. It's just a cost of doing business, and I assure you one negative won't be a financial loss.

Also, I dont understand the fact that he replies me on Tueday (the day of delivery of the phone). If he wanted the phone so urgently, he should have contacted me on Thurday/Friday (or over the weekend) regarding the status of the phone and where it was. I had used e-USPS email notification (entered his email address) when I printed out the shipping label from USPS website, so he definately had access to the DC # all the time.

It seems like he waits for the item first, and then tries to extort money by blackmailing the seller later. Do you guys think that he does this to all the sellers he purchases stuff from ?

Nah, I'd keep it professional, something like:

"Shipped within 48 hours, offered refund, www.tinyurl.com/#"

Something like that, avoid taking digs at him, here or there. People who are curious will check the url and come here, and see that you were looking for advice on resolving it, and that you did indeed try to make it right (even though you were NEVER in the wrong).

Well looks like he left neg FB. What a dick.

Anyways, I wanted to let you know that you MIGHT have a chance of removing this negative via Ebay help. Let me explain.

A few years back, some deadbeat did a "buy it now" of one of my auctions. I immediately sent him an email telling him how much he owes and whatnot. A few days pass and nothing, send another reminder. Another few days pass..yup nothing.

so after about 1-1.5 weeks later, I file a non-paying bidder alert, relist and go on my merry way. I also left him negative feedback (he only had 3 at the time of winning my auction while I had 30+ 100%). I thought all was good.

3 weeks later, I receive my negative and he also sent me an email saying that "He paid and never received item..." (total BS) and he even threatened me that he would ruin my other auctions if I ever contacted him again.

So I went to eBay's help file and searched for removing negative feedback or something similar to that and I found a link that led me to a "request feedback removal" page which I filled out with all necessary information. Ebay then said they would try to contact the other party and if they didn't hear back from them within a certain time, the negative would be removed from my FB rating. Well, fortunately for me, that asshat never responded so my only neg was removed.

Therefore, when people or even eBay says that all feedback is permanent, it's not. You can remove it if you file/request it. Unfortunately since this was so long ago, I don't remember how I did it except I started with the Help Search and searching for something about feedback removal.

So definitely try that out and who knows, you might be successful in removing that undeserved neg. Good luck.

ps. I really feel like emailing this ahole and telling him how much of a tool/douchebag he is. Someone needs to key his car.
