Ebay and Paypal Question; I got scammed

Hey ppl,

I've been lurking around here for a while and finally decided to join up. Anyway, I just have a question about ebay and paypal. W/in the past 2 wks, I used buy it now to purchase an "Authentic as it gets" 2003-2004 Mike Vick Jersey. I paid for it using Paypal and got it shortly after. I never took the tags off, or wore the jersey, but after comparing the jersey I got to ones in stores, me and my friends realized my jersey is fake. The "7's" and "Vick" are all made of an EXTREMELY cheaper fabric; it feels like the same material they use for the sleeves. Also, the word "Falcons" is a sewn-on patch, instead of being sewn DIRECTLY on the jersey.
I tried emailing the seller, and he hasn't responded, and after getting his phone # thru ebay, I found out it was disconnected. I've sent emails to ebay about it, but they keep responding with the same generic email. I filed a complaint with Paypal to try to get my money back, but they haven't responded yet. What else can I do? Is there any way for me to get my money back other than thru Paypal, like talking to my bank about it? (I used my debitcard.)

The worst part is that he's now under a new name, pulling the same scam. He's now under "xs2stylez;" he's using the same description, pics, and is also from brooklyn. All his feedback are from mainly useless "wholesale lists" and items under $1.00, obviously just to boost his feedback and seem reputable.

I did that Buyer Complaint Process thing with Paypal, but they haven't given me an answer yet. Ebay keeps sending me basically the same email telling me about my other options; can I file a complaint with them now? B/c I remember them saying something about how I have to wait b/w 30-60 days 1st.

Oh another thing, what authorities could I report this guy to? He's blatantly ripping alot of ppl off w/ these fake jerseys goin @ $90-120 a piece.

It's only been 2 weeks. You did the right thing by filing a complaint with PayPal. That's about all you can do.

If you send it back to the seller, they should have no problem refunding you.

If you paid for something and he scammed you, and he sent it thru the post office, that is postal fraud and is a felongy. You can also contact the attorney general of the state the seller is in.

sorry this happened to you. Out of 340 transactions on Ebay, I was scammed twice... $40.00 and $65.00. not exactly a fortune, but it still stung at the time.

How'd you fund the Paypal purchase? Credit Card or bank account? If you used your credit card (correct me if I'm wrong) you can call your credit card and dispute the charge.

Hmm.. Good point. ;)

Well.. maybe PayPal will reverse the charges.

If he isn't ripping people off in the hundred thousands and is only making like a few hundred bucks the authorities won't even bother/care. Just try your best to get your $ back from paypal.com.

Remember, sports goods are very often faked. I remember once hearing that 75% of all signed memorabilia was not authorized, even when it was sold in legitamite channels.

Buyer beware.

I bought it now for $120 and $6 shipping. I used my mastercard debit card to fund it. He sent it thru UPS, but it was sent in a USPS bag, so I think it might be one of those times where UPS and USPS work w/ each other. Could I really report him and get him on a felony charge? Aside from the ebay name he used to have I have the "real" name he uses under Paypal.

Is there any crime at all I could get him charged for? I've bought alot of things off ebay before but this is the first time someone has deliberately ripped me off. I feel even more worse about it b/c now he's doing it again under a different name. (I forgot to mention, I also have the address he gave under Paypal.)

Paypal isn't going to do anything for not as described items. Sure, you can file a complaint and maybe that will scare the seller into refunding your money, but otherwise a few days later you'll just get a generic form letter stating paypal isn't responsible for this type of situations due to their TOS. If you paid with a credit card logo then you can due a chargeback that way, but your paypal account will be permanently locked as it will be you who violated their TOS.

what's a chargeback and how do I do it? Do I contact mastercard, the bank that handles my debit card, or paypal?

But I thought Paypal does cover misrepresented items. I'm not sure how they consider something to be protected under their Buyer Protection Policy or their Complaint Process. Does any1 know how they decide if you're under either one?
