Just to clarify, I think he should take whatever steps are available to pressure the seller into completing the transaction.

If he leaves a neg though all that will happen is he will be negged back which will ruin his account. I would never allow someone whose only feedback is a negative bid on one of my auctions.

On the other hand if he negs the seller it won't do any good. The seller will reply to the neg with a BS excuse and anyone that reads it will see a neg that was left by a nobody with no feedback and a reasonable sounding excuse by a "well established" power seller.

The thought crossed my mind but not until I had fired an e-mail off to both the seller and e-bay. Funny thing is the date on the e-mail according to Hotmail is 12:20PM tomorrow. It would have worked perfectly. 🙁

Btw he replied to the e-mail I sent him:
"Dear kalypsos_consignments,

I really do not understand. I realize that you as a store made a mistake not I. I don't think that I should be punished for that mistake. I have contacted e-bay and reserve my right to post negative feedback."

with

"We will not keep you from bidding on these items when they are posted. The listing was meant to be launched as a reserve price auction and not a buy it now. If you feel you need to leave negative feedback then that is your position. We were just trying to let you know we made a mistake and that we could not let you have these speakers unless you bought them through an auction. I want to say we are very sorry for any inconvience that this may cause you. However, our position will not change."

I wonder what would happen if I took them to small claims, I know my father would back me but I don't think I'd have any true legal ground.

I'll leave a negative but I've already bid on some other things. I'll leave it after those are over, shouldn't be more than a day or so.

I've already thought about this. While retaliation negatives are against "ebay policy" I doubt they'd do anything about it so I guess I'll just keep searching for speakers else where. That said my dad wants me to push it, he doesn't care what it takes. 😕

Just an FYI for all in case they care... I emailed eBay about what they would potentially do against retalitory negative feedbacks given... (because I was in a similar situation and didn't want to get a neg against me for doing nothing wrong). They said that it can happen and they won't stop it, as it would "devalue the rating system" ... 😕. They strongly urge us to compromise directly with the other trader to resolve it rather than leave a neg to avoid such circumstances.

That is truly dissapointing. They are devaluing the feedback system singlehandidly through policy.

If you feel you need to leave negative feedback then that is your position.

Basically they're saying they don't want you to get such a good deal, and "screw you because a negative feedback on me w/ 1200+ positives from a person w/ "0" feedback won't mean a thing".

Sucks, but I guess you just leave a neg., contact eBay, and move on. And yes, under NO circumstances will eBay remove or modify feedback, even if it is in retaliation. It's so gay.

no its definetly against ebay rules.

if he had cancelled any bids he got and ended the auction early, thats perfectly fine. but once the auction is over thats a binding contract, contact ebay

Just threaten to take him to court and he may just end up selling it to you to save the hassle. Perhaps you should just bluff him.

Oh believe me it won't be just a threat. I will do everything in my power to see that A) I get the speakers, B) The seller's account is suspended, or C) Both.

The seller made the mistake, not I or his client. He should be taking some heat for this.
