Nobody's forcing you to buy a physical copy since their games are also available via digital download.

Additionally, if you purchase a physical copy and want to read the EULA before installing it, you can contact EA and request a copy of their EULA in writing prior to opening the box.

However, nobody's going to do this because NOBODY IS THAT STUPID.

Plain and simple, nobody's forcing you to use EA's services, play their games, use their servers, or give them your money and there is ALWAYS a solution to whatever stupid bullshit problems that you think you're clever enough to come up with.

EA does not control store policy and there ARE companies that will take back opened games. Or, rather, there were last time I looked; used to be my favorite place to go for games because they'd give me in-store credit for my old stuff without my having to go to those GameCrazy whores that give, like, a freakin dollar in store credit and turn around and resell it for $30 or something.

I can't remember the last time I went to a store to purchase a physical copy of electronic entertainment.

This is irrelevant. They give you the EULA on the disc and give you the option to refuse it. Problem is refusing it means nothing because you can't get your money back anyway.

As for Steam...you cannot return games so not sure what you're talking about there. Only pre-orders. So if you launch your steam copy and suddenly think the EULA is bullshit...too late. You can't get your money back.

The EULA on disc isn't the only method to obtain a EULA and read it. If you're that concerned about it, but buy the game anyway and open the box, you're a fucking moron.

Additionally, you have to agree to Steam's EULA before making the purchase. Have you ever read it? Of course you haven't or you wouldn't be arguing this right now.

That's bullshit. I just bought M:TW about 5 seconds ago and all you agree to is the Steam one. There's no EULA for the actual game. You cannot see it until after you purchase it. And guess what...Steam wont let you return the game anyway which render the EULA null and void. I'd like to see that stand up in court. That's like only being allowed to see the terms and conditions of purchasing a car until after you've purchased the thing.

Lets say John Doe goes to best buy, he buys a shiny new game. There is no mention anywhere about a EULA, DRM, or that EA may terminate his ability to play that game.
Now he goes home and installs the game, what is that? a EULA! A EULA that says he must agree to any changes they make to it retroactively. And that he should return the game if he doesn't agree... well he doesn't agree but he CANNOT RETURN THE GAME! EA has only shown him the "contract" after he already paid them, and if he refuses... well they keep the money and he doesn't get to use the game.
Your argument is "He should have known", but the only for him to know is to have been the victim of it before (of the surprise EULA that is) or heard it from other victims. The first time a person purchases a game from EA (or lets be honest, most companies), they find out a nasty surprise in the form of a post purchase EULA that was never mentioned anywhere prior.

Imagine the same thing happens with a car?

Also I would like to see where exactly in the terms and conditions of the EULA does it say that EA has the right to deny you the ability to play the game.

EA isn't always that bad. They gave me a 15.00 credit because my 10.00 promo code from the recyclebank offer was limiting my purchase options. So I got Dead Space, Fifa 2010, BC2:Vietnam and the specact kit for free. At least the customer service is good.

No one's forcing him to purchase the game.

No one's forcing him to purchase from Best Buy, since there are other options available.

The EULA is available from the company prior to purchase.

You lose.

If there's something about EA's EULA that you'd like to know, you should try educating yourself for a change instead of sitting there in your ignorance waiting for someone else to post the entire fucking thing and highlight it for your lazy ass. :)

I suspect that's why EA backtracked on it so quickly. One of their lawyers probably went Uh... that's going to get your asses sued... and so EA put out the oh wait that's all an accident!

Also lol at Nik trying to defend an agreement that isn't presented or agreed upon before purchase; regardless of whether you can hunt it down on your own beforehand. That's even beside the point that even if you agreed before purchase the stipulations are so ridiculous that they STILL wouldn't stick, but whatever keep being the retarded ATPC lawyer.

I'm not defending the agreement, dipshit. I've said several times in this thread that I don't agree with that sort of activity. AGAIN, because you can't seem to REEEEEAAAAAD, it's their right to bar you from their servers if you act like a dick and if their games require server access to verify, you're shit out of luck and you reap what you sew.
