DVD Burner wont burn DVDs

I posted this in general hardware before I noticed there was tech support forum. Wow I am blind. Well they couldn't figure it out So I decided to try my luck here.

Ok I have a Lite-On SOHW-812S DVD-RW that refuses to burn DVDs. It reads DVDs fine, burns cds fine, and reads cds if it feels like it. The problem is that if I try to burn a DVD at any speed and either simulation or write, nero (and some others) totally freeze up like 1 second into caching the files or burning (if i dont cache). I tried updating the firmware to US0Q but it did not help. Also after i POST I noticed that it says DVD-RW ATA 33 and isn't 33 a little low?

Please help. I want to back up a dying drive.

UPDATE: I noticed that in the device manager I had the feared little yellow ! next to the my via bus IDE controller so installed the latest via 4 in 1 drivers and so it went away but the problem persists.

Specs:

AMD Athlon XP 2700+
Albatron KX600 mobo (via kt600)
512 MB PC3200 RAM CAS 3 (gross)
HDD1 WD 80 GB 7200 RPM 8MB Buffer
HDD2 Maxtor 30GB 7200 RPM 2MB Buffer
Geforce FX 5950 Ultra
Antec 430W psu

Assuming the dvd burner is on the Secondary IDE Channel, I'd delete it from Device Manager. Reboot, and see if it's still set to ATA 33.

Sorry, I meant deleting the "Secondary IDE Channel" from Device Manager. Once you reboot, it should be re-installed.
