DUI when you're asleep in your non-moving car?

The keys cannot be in the cab with the driver. If you are going to sleep in your car drunk, put the keys in the trunk.

yup, that's happened here in a georgia to a friend. keys in the ignition did him in too.

all you wanna be freedom fighters need to find a better cause to support while "fighting the man" because drunk people in cars are bad news, passed out or otherwise. what if someone passes out drunk in their car, wakes up in the middle of the night turns the car on and runs over someone while still in a drunken stupor? having the keys in the ignition make it that much easier.

go whine about something else, leave this one alone.

maybe because of habit?

maybe there was no reason?

Maybe he got in the car, put the keys in the ignition, then decided that he was too drunk to drive, so he crawled into the back and fell asleep?

had a guy in a class who was busted while sleeping

he had the keys in the ignition so that he could use the heater every couple hours

he was in a casino parking lot in Reno, and it was snowing

If I were your friend I'd demand a jury trial. No way in hell 12 normal people are going to indict, much less convict under the scenario you outlined.

Sucks cause I can see myself in a worse situation,where the car would probably be on to keep me warm.

so if someone leaves their keys in the ignition and listens to music the cops should still bust you?

last time I checked DUI = DRIVING under the influence. He was not driving, therefore he should not have been busted, PERIOD. The law is fvcking stupid thanks to retarded politicians.

I agree with the poster who said demand a jury trial. He can hopefully get it dismissed, especially if he has no prior convictions.

If I'm just sitting in my car, I put the keys in the ignition just so I don't lose them.

He can try to appeal, but yes he broke the law. Stupid as fvck, but the law...

It's always easier to enforce the letter of the law than actually taking into account the spirit of it. Theoretically, the justice system as a whole should work it out to enforce the spirit through a trial and lawyers, but it doesn't happen.
