shouldnt have any trouble getting off the charge, especially since the officer who issued me the ticket didn't verify that i was intoxicated.
so much misinformation here...I'm on my phone so this is short, but if impairment can be proven, you don't even need an .08. Sure it's a lot easier to prosecute that way, but to think that you're a-ok just because you're at .079 is idiotic.
You were quite likely higher than 081 when you were stopped. How much time passed between when you were stopped and when you blew?

Just keep paying the money to the lawyer and he'll tell you everything you want to hear.
It's not about what he does in his home...for all I care he can put on a green dress and high heels and dance to Abba in his home.
The point is that he made a poor judgment by drinking excessively, then driving, and he suffered a legal consequence for that poor judgment. Then, shortly after, he decides to resume the activity that got him in trouble in the first place.
Honestly, how many people get nailed for a DUI and then think shortly after "Well, shit, I may as well drink more until I pass out". Definitely evidence of problem drinking.
not much time, because it was a check point. I pulled up, he asked me to pull to the side, and step out. at which point i was approached by someone who identified themselves as a volunteer for the DUI check point, wearing a hi-vis vest with no badge or any police identificaiton. He ran me through the field sobriety test, and had me blow. He went and got a real cop, and the cop issued me the ticket, without even doing any of his own tests. I asked him for a blood test verification and he said there were no on sight paramedics to administer it. I got the ticket, the cop walked away, and the volunteer stuck around till i got i called my girlfriend, she picked me up and laughed at me. Drove me the 1/2 mile down the road to my place. I posted on atot, had some more drinks, passed out and woke up and called my lawyer.
Drinking to drown away the problems from a DUI...you should seriously ask your lawyer about putting you in to an AA group.

Having someone who isn't a sworn officer do a field test of a driver of a stopped car won't hold up as impairment anywhere that I know of.
We ran into a similar issue when I worked at Ft. Campbell. The gate guards, who were just civilian security, would call us saying that a driver might be impaired. Of course when we got there we couldn't see the car drive, because it was already pulled off to the side. Using someone else's word was iffy for pc to even do a field test.

.081 ..... .001 more than the legal limit. i had 6 drinks over 4 hours and i weigh 170. i did the math and figured i was ok to drive.
