DSL modem problem

This is for AT&T in So Cal, I hooked the modem up and conifgured it, it will connect to the net but the connection will go up and down, I ran a ping google.com -n 100 10 times and every time 13 packets drop, it drops a few packets in a row a few times. I want to assume the modem is fine, but I have no idea what else to check on it, it doesn't have many options to configure it. He bought it from Best Buy and it's been over a month so if infact if it the modem he might have some hassle getting it replaced.

just wodering if anyone here has an idea for something I should try before I have him call AT&T and have them send him a replacenment.
