Drunk driver crashed her car into my porch

Let me start from the beginning. I work nights, so I sleep durring the day. I came home Sunday morning, and went to bed. I woke up at about 3:15PM so I could grab a shower, get dressed, and go to dinner with my wife and mother. As I am stepping out the shower, I hear something. I grab some pants and a shirt, and run out. Some older woman had fallen asleep as she came up the hill, hit a utility pole, and spun her car around, almost landing on the edge of my yard, about 6 or 8 feet from my porch. I was releaved she was ok, and my house was ok.

We went to dinner. We talked to my mom about it, and I was saying its a bad bend in the road, and I hope no one drives into our house. We have owned it for two years, and the house its 75 to 100 years old, and it had never happened before.

So, we get home, we sit down to watch Dexter at 9PM. Right in the opening credits, BOOM. Someone smashed into my porch. I run out to see if everyone was ok. It was a newer Saturn Ion, with a female driver. I couldn't access the driver door, so I ran to the passanger side. It was locked, so I start yelling "ARE YOU OK? 911 HAS BEEN CALLED. DO YOU NEED MEDICAL ATTENTION?" She was acting funny, so I thought she was hurt. Nope, really really drunk. She wouldn't unlock the door, so I ran into the house to get my Maglight so I could see because it was dark, and to smash the window and pull her out. When I came back out, she had already crawled through the passannger door, and took off running. We called 911 again to report which way she was going, and what she was wearing. The state trooper arrived about 5 minutes later, took some info, and then two more troopers arrived. They went to check for her at the bars down the road, About ten minutes later, they had her cuffed in the back of one of the cars. We ID'd her, they took some more info, called a tow truck, and took her away to be booked and jailed.

So, we called our insurance companies 24 hour number to report it, and called our agent to leave a message. I got her auto insurance company and policy number.

This morning I call her insurance company. It is a sketchy one for high-risk drivers. They said that she was not on that policy, and that is that. Nothing they can do.

State Farm (my insurance company) told me to get the estimate on the damage and all that.

Here is my problem.

A car came into my house. Directly to the left of image one is a white door. That leads to my living room. Against that door (we don't use it) is my chair I sit in while I watch TV. It is about five feet from where that car is. My wife and I would like to raise a family in this house. How are we supposed to have any peace of mind now? And, later in life when we decide to sell and buy another home, we would be required to inform any buyer of what happened. I know when we went house hunting, all places had a disclosure of any repairs done and incidents that happened in the house. What kind of drop in value would we see?

I am going to call around for an attorney eventually after I get some more info, a police report, and etc. I don't have a lot of money, so I hope I can get one that will not charge a fee unless we get some money.

I couldn't sleep last night. Every time I heard a car coming, I was instantly awaken. I hope its just some temporary anxity and worry. If it lasts for a few days, I am going to go see a doctor. Right after it happened, I was fine. I was glad everyone was ok, and my house was still livable while we waited for repairs. My wife was upset, but she is ok now. But after everything settled down, my mind kept racing. What happens if its a big truck next time? It almost happened twice in one day. What happens if they kill my dog or something. He likes to sleep next to my chair when I am not home. Gahhh.

Anyone ever been in a situation like this? I really don't know what to do. I have never had to do any insurance claims. Auto, home, etc...nothing.

I would like to sue. But I don't think she has auto insurance...so I would have to sue my own insurance company. Is that common? Does it work?
 
First pic doesn't work, FYI.

Is there any way you could build a small retaining wall there? Or perhaps a line of large rocks like at the entrance to hiking trails? Something to act as a barrier between the street and your house. Also, you could petition the city to put up those yellow << << << signs at the bend to make sure drivers are aware of it.
 
Can you install some road block in front of your house?

Wow, your house is too close to the road.

I would have the city put some massive concrete posts or something between the road and the sidewalk.
 
I was thinking a guard rail.

Its a very steep hill. 25MPH. There are signs warning of the hill. We see a lot of big trucks coming down the hill. We always thought it would be a truck that hit the house, if it happened. A wall or guard rail won't stop the 80,000 pound chemical tankers that frequent this road.

I was talking to a friend of mine about this a while back. He said someone in his family did something similar with a block wall or something, and it did get hit eventually. They got sued by the driver because they were injured more by hitting the wall than they would have been if they went into the house. This shit is ridiculous.

i've seen similar properties around here and people complaining about their houses getting slammed into

Doubt she has much money. Sueing her would be a civil matter, and you can't get much out of someone who does not have anything.

OP if she is not covered under that insurance policy, then get in contact with her and find out if she has other insurance. If she does not you can sue for damages. The police report should list all of her information, and if you can talk to her parents (sounded like she was early 20's so might live at home or is on parents insurance) try to get the policy #. If she doesn't have insurance make sure to let the police know so they can add those charges to her, and that will be something that would make her life hell to get insurance at a reasonable cost for a while. Your home insurance should cover the repairs, and it shouldn't affect your rates (I can't say for certain, but seeing as she was liable for the damages it shouldn't affect your rates). I don't know if you filed a claim under your policy, but if you haven't don't (if possible). Go through her first and try to get an active policy. File against your policy as a last resort, because excessive claims can affect rates. It also will show up in the CLUE database as a claim, and could affect your insurance in the future (even though you are not at-fault, it still is a ding against you).

Glad to hear nobody was injured.

It wasn't her car. It had out of state plates. They said her address was just down the road from me. The car she was driving was insured, but not to her.

True, but that does affect her and would be something that would be on a background type check (I believe credit reports as well). Even if you can't get money from her, you're insurance would cover the repair work.
 
Put up a big ramp; if any car hits it, they'll fly over your house Dukes of Hazzard style, leaving you and your family safe.

Now folks in Hazzard county hadn't destroyed evidence in a my excellent compatriot's age...
