Driver intentionally hits motorcyclist and doesn't care

Is perjury a thing in the US legal system?

It was a statement to the police, not a jury statement. Many States do what I said earlier its the drivers job to have their vehicle under control at all times if you hit someone its always the drivers fault. Getting a bee sting does not excuse an accident in most States.
 
I don't think I've ever illegally passed in a no passing zone. Where I'm at the zones are in spots where it is obviously a bad idea to pass.

In my experience, ability to pass in a no-passing zone greatly depends on the vehicle you are in, the amount of traffic, your visibility, and how well you know the area.

In southern rural Illinois, there's some state routes that are just 2 lanes (one each way) and are often marked as 'no passing'. But in a peppy sports car on a clear day you can easily make a pass.
 
The motorcyclist did not contribute to the driver's action of making him crash. In no way shape or form should making an illegal pass result in another driver intentionally causing an accident.

I could also argue (based on your logic) that if an illegal immigrant was at WTC on 9/11 and they died in the attack that 'being an illegal immigrant' contributed to their death since they were doing something illegal when they were attacked.

All of the circumstances contributed to the outcome. The motorcyclist was poorly equipped, unlicensed/untrained, and made poor operating decisions. The car driver also made poor decisions.

Again, I haven't seen much of an argument that the illegal pass was justification for what the car driver is accused of. I'm not sure what you are getting at.

Sure, but I don't know about leaving it up to the drivers confidence in their own ability to pass safely. That seems like bad policy.

I used to live in central IL and believe it was legal to pass slow tractors in an otherwise no passing zone, so I understand that about IL. Where I live now everything is a little less restrictive than there.

Will have to see what the results of the investigation are. From the video, it is difficult to tell if the car hit the motorcyclist, or if the motorcyclist hit him

Good point. Is it confirmed that there was contact at all or did the rider panic and dump the bike?

You know damned well what I'm getting at, and it's that the illegal pass the cyclist made is irrelevant to what caused the actual accident. The driver of the vehicle is 100% to blame.

Had the crash been due to an 'accident', meaning the driver clearly didn't intend to hit the cyclist, then the cyclist would have more responsibility because they were somewhere they shouldn't have been.

But it wasn't an accident. The driver intentionally hit the cyclist.

Which video did you watch where the quality was high enough to determine if the vehicle hit the motorcycle, or if the vehicle moved into the lane and the cyclist hit the back corner of the vehicle? Link please.
 
Wow, that driver pulled some Judge Dredd shit there, taking the law into his own hands. He determined that the biker broke the law, set the appropriate punishment as death, then attempted to execute the biker.

All you idiots defending the driver are ok with someone like that on the road? And don't tell me you've never sped or broke any traffic laws ever, you're a terrible liar. How about next time you violate a traffic law, this idiot driver enforces his justice on you. Damn any reason you needed to break the traffic laws like... i dunno, an extreme emergency.

As far as a wasp in the car its no excuse your car needs to be under your control all the time there is no excuse for losing control of your car.

I don't condone, nor am i defending the old guy that hit the biker, but this comment is.....i'm not sure of the right words to use honestly. Things can get in your car and surprise you at bad times. things happen. different things bother people in different ways. People react differently. i think i'd just slammed on breaks if the guys wasp story was true.

I've had a rather strange, large insect wind up in my car while driving with the windows down. it hit the mirror and slammed into the empty passengers seat. It looked like a cross between a large hornet and a bee. when i say large, the body looked to be about the size of my fist. it's impact with a metal side mirror only stunned it, not killed it. It didn't seem too happy. I slammed on the breaks and swerved off to the side of the road. Yea, i maintained control, but not everyone will. If it had landed on me or impacted me like it did the seat, i have no idea where i would have ended up. In fact, now that i remember that, i really dread hitting on while ridding my motorcycle. :-/ That was only my second encounter with that strange insect. I never did find a picture that looked like it. 🙁

you're right, but I also don't think that if you did swerve to avoid being stung, and you accidentally knocked over a cyclist, you wouldn proceed to get out of the car and tell the cyclist's friends that 'you don't care'.

If I was the guy in that car and I caused that accident (by accident) I'd have pulled over immediately, called 911, and rushed to the motorcyclist's aid.

That old fuck just stood there proud to say he didn't care.

Also, if it were just an accident and the guy accidentally swerved out of his lane, what if he had hit an oncoming car and not the cyclist? He still would have caused an accident and the oncoming car wouldn't have been at fault. (just like I believe the cyclist was not at fault, at all)

I find it hard to believe the driver just so happened to be avoiding a bee sting and swerved just as a motorcyclist was trying to over take him. It's about as poor of an excuse as someone sucker punching someone then proclaiming they 'slipped' and their fist accidentally hit the victim's nose.

I'f not defending either of the people involved. I really do feel bad for the girl that was on the back of the bike. I just didn't like the way/what Fanatical Meat said. the bit i have quoted. To me, it read like, you can always maintain control of your vehicle no matter what. may not be what he meant though.

Oh, yea, for sure. Nobody is perfect.

What blew the old man's case was his indifference to the accident. He was smug, admitted he 'didn't care' that he caused an accident, and couldn't be bothered to help.

Only someone who was happy to have caused that accident would react that way. He was smug because he was happy with 'his work'.

It's obviously a lie because even if you were stung you would still "care" if you accidentally injured a biker and his passenger and damaged your own vehicle when reacting. He "don't care" because he did it intentionally.

I think you assume too much.. that's the problem..
We don't know exactly what happened inside the car, it's all speculation. Maybe the driver might have said that angrily because the biker dented his car, when he swerved to avoid being stung..

The fact that everyone know about: The biker should not have been there in the first place. If the biker follows the rules, he would never have been in that situation.

I'm not making assumptions or using poor logic. The driver was clearing saying 'he didn't care' about the accident and that he caused it. You have to be intentionally obfuscating things to deny that. Sure, when the drive thru asks me 'do you want fries with that' there are other 'possibilities' than what they clearly asked, but you have to be intentionally looking to confuse things to be that absurd.

I don't feel bad for the biker at all, the guy was a complete idiot, he should also be charged with endangering his passenger with the way he was riding and not providing her proper safety equipment. When I carry a passenger, their safety is paramount. I feel bad for the girl passenger, she put her life in the hands of such an irresponsible biker. The driver of the car should be charged though if it turns out he did intentionally hit the biker.

If swerving to avoid something makes you hit someone else you should have avoided it earlier or stayed further away from the person you hit or drive slower.
I know accidents & mistakes happen but when you're driving a car you are more liable.
