Drinking in a parked car - illegal?

So I went to a party last night and was about to pregame by drinking a can of Bud Light, after parking my car and removing the keys. My friend / passenger freaked out and said that the act was illegal. Was she right?

I didn't drive home drunk, by the way.

Open container here.

You go to jail for "Intent to Drive Drunk".

Living in a college town and having seen too many police officers abuse their authority, ticket college students for innocuous acts, and leave bums publicly drinking and smoking weed and rich old men/women socialites driving Lexus and Mercedes recklessly alone.

Edit: I fail at editing.

Normally you can't get the Intent to Drive thing unless the keys are in the ignition. However drinking in public / open container in public can get you. Doubt it would be that bad though unless the cop was just being a dick.

so the one internet post complaining about police justice must obviously imply the poster is a speeding ricer. quality reasoning

if your car is on your private property you can do what you want. if its on public property the keys in the ignition mean nothing. its the same as sitting on a park bench and drinking.

I had to post this. Awesome comeback! 😀

You can in Tennessee. Hell, some friends and I were driving back from a Braves game, and once we hit the Georgia/Tennessee border coming home, all of us (minus the driver) cracked open a beer and tried to finish a case before we made it back home. We succeeded.
