Douche sueing M$ because of defective Xbox 360s....

Wouldn't the case hold up only if the defective product cause some kind of property damage or injury? Say the unit overheated and started a fire and burned down half your house or the unit exploding sending plastic shrapnel everywhere.

Similar to automobile manufacturers getting sued due to a design flaw that causes the gas tanks to exploded on impact.

Thats exactly my thinking. If my car's battery didnt work properly, I wouldnt sue Jeep (Liberty) because of the defective product (unless damage was a result), I would have them fix it. But then again, the 360 isnt a car and wont blow up. I could see someone getting pissed that the discs are getting scratched but seriously, there are devices that can fully repair scratches ($20 at BB) and you could probably return the 360 if you wanted to fix it.

Good for this guy. I'd say I'm a shade below being an MS Fanboy, but MS has willingly and purposefully has kept the quantities shipped to stores LOW, knowing that people would jump through hoops left and right and destroy each other for their console.

So after he has to break his balls to get the thing, he can't enjoy it for more than an hour or two because Microsoft didn't properly construct it? Now he has to wait 6-8 weeks to replace something that is already paid for that he only got to enjoy for a day or two? I think you guys are thinking he's just a whiner, but what about the ipod batteries? You people bitched about those for a year then praised the people who filed the class action suit.

Despite what many of you think, 3-5% defective is HORRIBLE. With the amount of sales that consoles do defective rates, no matter what the problem, are expected around .5%, and not acceptable past 1%.

If the original XBox sold 5 million units (I'm not sure of the actual number), are you saying it's acceptable that anywhere from 150k to 250k of them didn't work? Even at the reduced price, that's as much as 37.5 million dollars in loses! Even for Microsoft, that's ridiculous!

Raising a stink and filing a lawsuit are at completely different levels. MS was already offering unprecedented restitution before this "douche" filed a lawsuit by offering to repair or replace 360s atMS's expense within 5-7 days.

The level of SUBJECTIVE quality in a restaurant meal and a product working as advertised are also very different issues.

Do not block any ventilation openings on the console or power supply. Do not place the console or power supply on a bed, sofa, or other soft surface that may block ventilation openings. Do not place the console or power supply in a confined space, such as a bookcase, rack, or stereo cabinet, unless the space is well ventilated.
Do not place the console or power supply near any heat sources, such as radiators, heat registers, stoves, or amplifiers.

If my 360 breaks while it is under warranty, I'll just get MS to repair or replace it. If it breaks outside of the warranty then I'll be SOL because I didn't pay to get the extended warranty. Simple as that.

Now, if the 360 starts causing house fires or starts molesting my cats....then there may be a case for a class-action lawsuit.

Computers overheat when not properly ventilated. I guess they shouldnt either?
