In December 2020 a Fox News reporter dares to go live and fact check Trump. Which prompted this internal email from the CEO:

“This has to stop now,” Scott said in a December 2, 2020, message.

“This is bad for business and there is a lack of understanding what is happening in these shows,” Scott added. “The audience is furious and we are just feeding them material. Bad for business.”

How pathetic must one be to get their "news" from this channel. If all they are doing is telling you what you want to hear, then why watch news at all? Just make up shit in your head and say that is what's happening in the world.

Ruling by Judge today on the summary judgment motions in the Dominion v Fox News case.
1) Fox Corp and Fox News' motions for summary judgment to dismiss the case have been denied.
2) Dominion's motion for summary judgment is granted in part and denied in part.

Specifically, the judge has ruled that Dominion was in fact defamed - Fox made statements of fact, and not opinion, that were defamatory.

However, he is leaving up to jury trial whether there was actual malice in the defamatory statements, and whether Fox Corporation (parent of Fox News) is responsible/liable for those defamatory statements

(edit: and whether there were in fact damages to Dominion, and the amount of such damages, also left to civil jury trial)

Yep, most of Fox's defenses were thrown out by the judge as matter of fact pre-trial. Pretty ugly for Fox.

Fox are down to now arguing just 2 defenses: there was no actual malice (that is, the reporters and their bosses actually believed the lies they were spreading about Dominion changing votes and stealing the election - as at the time they aired them), or that Dominion suffered no actual damages from their lies. And they can argue that Fox Corporation is not also liable, potentially limiting any liability to just the Fox News subsidiary.

Looking over the court's ruling on summary judgment, it leaves only the issue of malice for the jury to decide. Fox News is going into the trial with the jury being told that it published multiple false statements about the plaintiff. Literally their only remaining defense is they did so without malice.

Malice in this context is not the same as malice relating to murder. There doesn't have to be any ill intent, any intent to harm Dominion. Only that Fox News either knew or should have known the statements they published were false.

The problem is that Dominion sent cease and desist letters explaining in detail how and why the statements were false. And also, Fox News itself fact checked the claims and found them false. And Fox News, in turn, neither published Dominion's refutations of the claims nor the results of its own fact checking. Only the false statements.

We aren't even in the vague "should have known" territory. They knew, and I think the evidence is conclusive. This isn't even going to be a trial over liability. It's what we call a "damages case." Like with a rear ender auto accident where the defendant is always liable and the trial is just over the amount.

Let's see what the jury does with punitive damages here. This could be a watershed case.
