Does this seem fair?

OK, yesterday some guy wanted to show me suny purchase, a college. I really didn't want to go, but the guy wanted to take me to show me, because he said it's nice. So we went, we looked around we were about to leave. He saw a box and wondered what it was.

I didnt want him to open it, it was just out there though but he just wanted to see. It was the knicks. It didn't say do not open, and I bet it was clothes. He opened it, I didn't but anyway it was a small TV. We than put it back together and wanted to get out of there.

Than an evil mean woman came, and said what are you doing? She asked if we were part of the knicks (what a smart question) and we said no. Than she asked if we were students, we said no, and she told us to leave. We were leaving, and she called the cops.

They were going to press charges and all, and said we were searching through lockers and everything even though we didn't. They called the Knicks management, and I bet told them all of that and the Knicks management said they didn't want to press charges or anything. They were just going to charge us with a violation, attempted larceny and trespassing.

After like being there for 2 hours, they just realized I wasnt 18 and sent me to another room said they were going to let me go.

They charged the other guy, and like after being there for 4 hours, they said we can go. They made us sign papers that we are declared persona Non Grata on the place, meaning we cant go there again, and if we do we will be arrest for criminal trespass.

Well this morning they called me and told me I have to go back there so that they can charge me with trespassing. They said if I dont I would have a warrant for my arrest, and I must go there. They just want to break my balls. It's not even like I have to just pay a fine, I have to also go to court over this. My moms going to be real pissed, because I have to miss school for court and this and that. This sucks and this is just a rant.

Where the hell were you wondering? I doubt a charge of trespassing is warranted..

However, talk to a lawyer! If you were walking around and had right to be there, you're case will get thrown out so fast. You could probby even counter-sue for such a waste of your time.

BTW, what is the knicks? The basketball team??!

Was this still on the grounds of Suny Purchase? Is Suny Purchase a public or private college?

This seems extremely strange to me.. saw you opening a box, so they try to charge you with attempted larceny and trespassing.. lame. Did they read you your miranda rights when they detained you? If not, then you're golden. My brother had a similar thing happen, and got off, because they hadn't read him his rights. Just try to think of any possible loopholes.

Yea, the knicks the basketball team. I mean supposingly we werent supposed to be there, at the gym. We werent really doing anything in the gym though, just walking around. Lawyers are expensive, and they will just give us crappy ones. You know what was funny, they were pissed because we wouldnt sign away our rights.

They read me my miranda rights. Suny purchase is a State University Of New York, so would that make it public or private? There are tons of suny's and I would think that it is public, I am a New York State Resident.

When I was arrested for breaking golf carts with three of my friends, we majorly pissed off the police, because none of us would say a word for 5 hours, until all of our lawyers got there. :) Smart kids, we were.

If it's a state university then it's a public school, but it doesn't mean you weren't trespassing. Sounds like they are just overreacting, though.

If it is public (which it sounds like), then it shouldn't be trespassing.. That'd be like them charging you for trespassing on a sidewalk. If you pay taxes, you pay for the upkeep of that college, and therefore should enjoy fair use of it. :) Trespassing shouldn't even be a crime, when no other charges are present.

I doubt the gym itself is open to the public, especially if the Knicks practice there or something. Just because it's a public university doesn't mean you can just go wherever you'd like in it.

Honestly, I think it's because I'm asian. Thats what one of the asian cops told me. It's because they see two asian guys walking around, they get all scared and suspicious and make a big deal out of nothing.


Edit: The asian cop that works there. He couldnt really do anything about it though.

We werent actually doing anything in the gym. The staff saw us there, never asked for ID's or anything there were no signs posted. We werent using any facilities in the gym.

But you were on private property without permission. I would imagine that technically it's trespassing.

LuNoTiCK, your first post said nothing about being inside a building. I can only wonder what else was left out of the story. You were on a college campus, in one of the buildings, when a lady sees you digging a TV out of a box while you had no reason to be there? I think I can see why they called the cops.

Woah, how are you going to say what I was doing? You weren't even there, so how are you going to say that I was leaving parts of the story out. Ask a question, and than I would give you an answer. Besides I did say what I did. So your accusing me of doing something. She didnt see me digging a TV out of a box. All she actually saw was us putting the box back. Besides I did say we were just looking around, you usually dont just walk around on the outside all day.

I get where kranky is coming from. All we can do is guess why they went off. I'll bet stuff has gone missing in the past and there was no way to bag the culprits. Now you guys come along, acting suspicious... BAM! Perhaps if you had a little better story of why you were there without an invitation or official business, it might have gone better. And your insinuation that it was racially motivated is worse than ANYTHING kranky may have insinuated.
