Its your american civil right to drink and drive? What about my friends civil right to go see his 9 year old daughter in the xmas play at school and gets killed by a drunk diver on the way there? What about that 9 yr old girls right to have have a father there when as she grows up thru the boyfriends and the school plays the school dances and the right not to think about every xmas for the rest of her life that she lost her father 1 week before what is suppoesed to a joyous and jubilaint time?, the right give her away when she gets married and has that first baby ? what about the rights of his wife to grow old with the person she love in love and devoted her life too ? What about the rights of the parents who had to bury their only child ? Where are their rights now that one person was so selfish and thoughtless that he had "one beer to many " ? Dont tell me about civil rights when it interferes with the rights of so many others.

I think they should stop pouring money into it.

the lobby exists solely to tack on other issues to it's agenda.

DUI related fatalities are one of the lowest motor vehicle problems there is.

Everyone who drinks has driven at least once while past the 'safe' limit (according to statistics).

Plus the whole law is very unconstitutional and the breathalyzer has been proven to be a terrible test and even if accurate who is to say .08 for one person has the same effect as another....

The whole system works because it's easy to pull the heartstrings of the public....I am not saying drunk driving is ok, I am saying their motives are money, not solving DUI/DWI....they have influence in a lot of unrelated laws, the MADD lobby is huge and wealthy.

The only way to get rid of drunk driving is to get rid of cars. Period. Nothing else will work. Even the computer controlled ones expected in 2080 will have some form of manual control, if only as an "emergency safty measure" in case the computer screws up.

"Had anything to drink tonight son?"

I got a DUI last Thursday night :/ my first and last. Blew .19 and let me say it freaking sux!

just like pot busts, DUI is driven by money. keeps alot of people in business (police salaries, counselors, fines, probation). people that go out and get tanked and drive do not give two sh!ts about any DUI law. theyre going to do it, regardless. and any of you that have had a beer with dinner is guilty of DUI. period. dont forget, you dont have to blow over the legal limit. you can blow .00 and still be arrested if the cops think you are under the influence. so i guess we are all baby killers.

Fine, then by your definition no one should be allowed to do anything that might in any way be harmful to someone else. We should all just stay in our houses in a fetal tuck and hope for the best. If someone drinks and drives AND kills someone they should be punished to the full extent of the law. On the other hand, someone who has 2 or 3 beers, gets in their car with a .09 BAC AND can control their vehicle with no problem is not guilty of committing a crime. They are actually less dangerous than people who are too tired, on over-the-counter or prescription medicine, talking on cell phones, not paying attention, too stupid to control their vehicle, too old to make good decisions, etc.

im not at all for driving drunk but i think .08 is too low.
you cant even go out and have 3 beers
after that i would be perfectly fine to drive.
but im sure i would blow a .08...
im sure they are going to try and lower to a .05 before too long.

true. ive had way, way more close encounters with soccer moms blabbing on the phone with the Yukon flying all over the road than ive ever had with someone i thought was drunk. then again, maybe the soccer mom was drunk too.

It probably will never cease to exist as long as there's such a thing as alcohol.

IMO the penalties should be stiffer (more jail time), but they should also be dependent on what offense it was and how much you blew. A first time offense for a little bit (say you had a drink at a restaurant) shouldn't be very harsh at all.

I spent 6 months on a DUI/Alchohol enforcement task force once, and I don't think we will ever totally eliminate DUI/DWI.

However, I think thier are many steps that can be taking to try and deter people from doing it more so than we already have.

On any given night we pretty much had the ability to pull in as many drunks as we wanted. We could sit outside TGI Fridays or at certain flashing red lights etc. and wait for the drunks to come to us. We could cruise the roads and find drunks everywhere. I found that over 50% of those we arrested were repeat offenders, and off those over half were driving on a suspended license. So obviously the penalties, such as fines, points, suspension of licenses etc. do not work. They are all over the place, and they really don't seem to care.

I think a better approach would be confiscation of vehicle confiscation for repeat offendors, mandatory jailtime/community service/mandatory rehabilitation and ignition interlocks. etc. That may sound harsh, but something needs to be done. They caer about this stuff a lot more about that than a fine, a few hours of paperwork, and a court appearence.

Some of you are also getting overly carried away with the BAC "limit" as a determining factor. No DUI/DWI arrest is made solely on the BAC. Thier are many other factors such as smell, the Standardized Field Sobriety Test, Horizontal Gaze Nystagmus, other evidence such as open or empty containers, and the subjects own statements etc.

I have probably testified in court about two dozen times in DWI cases and seen dozens of other officers testify. I have never once seen anyone say that well the defendant blew a .08 on the PBT, proceeded to ace the SFST, had no other standard indications of impariment, but I decided to arrest him and have him do the certified Breathlyzer anyway. Keep in mind that I also have the traffic offenses and observations such as speeding, weaving, etc. that I used as PC to effect the stop to begin with as additional testimony.

To claim that we are working on a numerically bsed system is total BS. Police Officers aren't robots and they do have training and experience along with the check of the judicial system to answer to. The limits are meaningless other than as additional guideline for charging. If I can testify to your impairment with a 0.0 BAC or I can have a Drug Recognition Expert (DRE) testify to your impairment due to some other substance I can charge you regardless of your BAC.

It is a combination of observations that will get you arrested for BWI. Proceed with the stories about how "I was fine" "only had a few bears" "MADD SUCKS" excuses. now.

People who wine about the BAC when they don't understand how it fits into the overall procedure should do some more research, maybe do a ride along with your local police department. Learn a bit.

Now when you can look a nine yr old girl and her mother in the face and give a valid reason for d&d then we we will agree but in my mind there is no valid reason. Now that being said, I do not think ppl who d&d are monsters or horrible ppl.Years ago I did d&d, but thru good grace noting ever happened. Would I do now? no I would not, I have seen the devastation it can have on a family, not only the victims but it rips apart the family of the person who did it. It is alack of judgement like driving while taking otc drugs or whatever else but it is a lack of judgement that effect a lot ppl and leave scars that can last a lifetime.
 

I'm usually the designated driver, so I keep it down to only like 12 or 13 beers.

No not all, ice cream company here had three divers in a month arrested for dui, they fined the company for not doing driving background checks as required. If it seems uttterly impossible then it probably true.

Oh my god breaking the law. I bet you never broken the law. Why the hell would you drive when you knowingly are doing something that might harm someone else? Every time you drive you are putting others at risk it is a fact of life there is nothing that we can do to ensure that other people will not get hurt. Why don't you just get into the fetal tuck and stay inside your house to ensure that you don't spread as germs.
