ALBANY, N.Y. (AP) ? Amazon.com is fighting Gov. Eliot Spitzer's plan to require online companies to collect sales tax from shoppers in New York, whether the companies are in New York or not.
Several other money-strapped states have mulled going after the taxes.
Spitzer's proposed budget would require Internet giants like Amazon to collect tax on an estimated $47 million in sales to New Yorkers, who are currently required by an honor system to report how much they spend online on their tax returns.
Amazon spokesman Paul Misener says the governor's plan would be a radical departure from anything currently being done in the U.S.
He says other states ? including California, Michigan, North Carolina and Texas ? have considered similar plans, but abandoned the idea.

Spitzer CANNOT require it, it's a violation of US Supreme Court precedent (Quill Corp. v. North Dakota). Unless a vendor has physical presence in a state, a sales and use tax collection obligation cannot be imposed. Unless Congress acts to specifically overturn Quill OR the vendor voluntarily collects and remits sales and use tax from its customers (e.g. under the Streamlined Sales and Use Project), Spitzer's up a creek.

He's arguing that the many New Yorkers who receive money from Amazon.com for referral links are sales agents of the company, thus establishing the company's presence in New York. So Amazon.com will just stop offering referral bonuses to New Yorkers.

If the NY rate is higher than the SC rate, than you'd pay just on the spread; you should get a credit for the SC sales tax you've already paid.
