I think a good sign of trouble in that situation is when the person replies with an, "Uuuhmmmm, ya, sure!".

The "Uuuhmm" pretty much implies that they'd rather not & they're giving you ample time to retract your request!!!

Similarly, when a member of the opposite sex replies the same way to your inquisition about......(enter come-on line here)........you know you're in trouble!!!

When they say sure, they're saying it in response to you asking for their pen. They're not directly answering your sentence's question but rather what you're really asking. It's "iffy" at best, it's not right and it's not entirely wrong. However, if you were writing, say, a novel, you would probably not have the person reply with "sure" unless his characters background was somewhat uneducated. Of course, I could be and probably am wrong. =/

I watched this week's episode of LOST and the same type question was asked and Locke replied, "Yeah, sure!" when he really meant, "No, I don't mind"

funny thing is that when they ask me "Do you mind...?" and I respond "No". They look at me funny :D
