Actually, I've heard that skin cancer can sometimes be traced back to single, severe incidents. Not sure how you'd prove it though.

While I totally agree with you the lawyers will say "I can proove over-exposure can cause skin cancer, can you proove this exposure wasn't the cause?"

It'll be easier to proove one vs. the other... Boat company could be fvcked on this one, cancer claim makes it doubly so.

The lawyers suing would only have to show it's likely, burdeon of proof is not the same as criminal charges.

BTW, I'm not a lawyer, but I did say at Holiday Inn Express! ;)

Being in the water while getting baked is *bad*. Ever notice how you burn like a mofo when you go swimming? Same thing, but 5 hours of it.

Edit - not to mention that while you're baking your resistance to everything in the water goes way down. Especially if it has /any/ salt in it. I'm sure the guy got to enjoy a lot of pain. :-/

When I was in my early teens - I fell asleep in a hammock in Panama for a good 4-5 hours with NO protection - got second degree burns on my back, all of my skin blistered up, preventing me from wearing a shirt for over a week (the pain was horrible) - parts of my shoulders are covered in scars from the incident too, and I have to have my back checked twice a year by a dermatologist for any signs of skin cancer.

Believe what you want, this guy has a valid claim.

I'm surprised they don't lose more divers around there. I've dived with several dive charter services going out to Catalina and those guys don't give a fvck about divers. No help whatsoever. They anchor the boat, you dive, the current's strong so you drift like a motherfvcker, and then you swim back to the boat. It can be a bitch in that current and when the boat's going, it's gone. I don't know, maybe I'm spoiled diving here in Cancun where the crew helps with everything, and the boat comes out to where you are to pick you up so you don't have to swim so much.

I received a burn on my upper arm many years ago, from falling asleep in the sun for a couple of hours. That part of my arm is now covered with that looks like moles, any of which could turn bad. And this was on land.

Being in the water for 5 hours is crazy, the water will reflect more of the light into you, making the burn much worse.
