disabled parking ticket

(note: if you were still engaged in the purpose of unloading - you said there was still a drying machine in the truck... thus, depending on the locality, you probably don't meet the definition of parking.)

First, you are guilty.

Second, go to court and explain the circumstances and you picked what you thought was the lesser of two evils.

Third, explain that under the circumstances you feel a reduction in the fine would be appropriate since you intended to be there a short time and were available to move the vehicle if needed.

Fourth, don't get righteous. That will cost you. The judge will be looking for contrition and a reasonable argument.

You may walk out paying considerably less if you handle this right.

463. "Park or parking" shall mean the standing of a vehicle,
whether occupied or not, otherwise than temporarily for the purpose
of and while actually engaged in loading or unloading merchandise or
passengers.

Here's one. Note the "otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise"

Before you pay the fine, make sure you read the specific statute that it was written under. It's possible that for a handicapped spot, their statute may be written specifically to not allow standing for unloading.

You "figured it was ok" because the other lots were full. This is not a valid argument for illegal parking. It does not justify any illegal action.

As per your statement, you had actually left the car. You were not simply "loading/unloading" but rather moving your stuff inside the apartment. You had left the premise of the vehicle, whether it be in, upon or alighting from the vehicle. This was a deliberate and calculated attempt to break the law. Your resultant fine is a reflection of that.

Only park where your allowed.

The law is the law and parking in a space that isn't 'legal' whilst say your not in the car to move incase cops/ traffic people come is NOT A GOOD IDEA!

I don't like people who park in disabled spaces who don't have permits. Should have parked somewhere else. Yeah it sucks but that is how it is. Same with speeding.

If you were "parked" in the spot for the purpose of unloading your vehicle,
then that's "STANDING" not "parking"

Not guilty.

Yes, fight this one.

It was a "Volunteer" Cop.

Doesn't care about the difference between "standing" or "unloading", just wanted to show he bagged somoene in the disabled spot.

Anyone truly disabled would have the common sense to see that an Appliance was being delivered and could've simply beeped their horn if they needed that spot at that particular time.

Agreed.

And whether it's a "real" cop or not is completely irrelevant, so do not bring that up as a defense. The judge won't be impressed at all if that's any basis for your arguement in court. Volunteer, reserve, traffic control, parking nazi, off-duty, part-time, or full-time, they've all sworn to uphold the law; they're all allowed to write you the ticket.

You said you didn't park in the fire lane b/c it would be towed. Next time, don't park in the handicap spot b/c you now know you'll be ticketed for that.

You're lucky - some states will suspend your license for parking in a handycapped spot.

Maybe next time doublepark and walk a few steps further?

I really do not feel sorry for you at all.

But go to court and try to get it reduced. But either way don't park there anymore.

*sigh* You're stoopid.... You had to know that you were risking a fine when you parked there... you really don't have anything to complain about. You're not gonna get off. The sign doesnt say... handicapped parking unless you need to unload stuff.

"Sometimes I park in handicapped spaces,
While handicapped People, make handicapped faces"

You are an azzhole😛

For arguments sake, what do you all suggest he should have done then? There were no parking spots and he had a truckload of items to unload to his new apartment. Just sit in the parking lot waiting hours for someone to leave? Park blocks away and take hours making long trips with heavy stuff?
You all know you would have done the exact same thing.

Fire lane. Much cheaper fine. 😉

Oh, and don't leave the vehicle there unattended, much less unattended for 25 minutes.

Being disabled it erks me when people use disabled parking when they don't have the right to park there. The reason the fines are so high is that if the ticket were say $15 you would probably do it again. You are lucky. Most municipalities in our state start the fine at $1000.

Park in the fire lane, unload the stuff to the side of the truck, park truck, take stuff to apt.

-or-

Clear it with the apt manager first, getting some sort of special permission to be there for 10-20 minutes.

you broke the law. There is no excuses. However, that ticket cost too much. Find out how much a ticket is parking in a tow zone or disabled space is and offer to pay that.

Damn. He parked a car illegally for half an hour, he didn't commit first degree murder.

Yeah, he should have parked in the fire lane but c'mon...

dude, I have a temp. handicap parking permit. I would've been pissed if I had to walk far because of you.

anyway, next time, park, unload, and move your truck.

can you people read?

he did park, unload and went out to move the truck AND TEH COP WAS THERE

and to the OP, id fight this all the way, especially seeing as the apt manager told you to park there to unload your stuff

I think what he meant was park, unload crap onto the sidewalk, move car, and move stuff into house. As opposed to park, unload crap into house, leave car unattended, return to see cop issuing ticket.

If I'm a cop, which i'm not, i'd write a ticket too if he left the car and went into the house.
