Part of the training of a military sniper includes counter-sniper training; being able to take out the other side's shooters without being seen.
Recently it seems as though our friend has a fondness for gas stations . . . why not request a unit of soldiers from the government (quietly of course . . . . if it shows up in the press he won't show) and let them set up on the roof, or whatever, and just wait. Might be worth a shot.

Because its Illegal to use military for policing inside the country. The only way around that is if the Governor calls up the national gaurd then they can use them that way, hence why they were able to get away with using them at the airports after 911.
