Ok, need some input on what you guys think I should do here, here's the deal:

I bought a toshiba laptop from this guy on the FS/FT forums here on anandtech. We worked out the deal for a good couple weeks through email and such, he sent me pictures of the laptop and all. Then, came to shipping. He didn't have any heatware, but he had about 15 feedback on another trading site (broadbandreports.com), and he tussled good when it came to working out a deal, so I figured he really was selling the lappy, and agreed to cross ship with him.

Ok, so then he dissappears before we finalize things. I call him up a few days later and find out that his father had had a stroke and he's been at the hospital all day every day, I tell him I'm sorry and such, and I can relate (my father passed away a month ago), and that we can work things out another time. He tells me it's ok we can get the deal done, so I tell him I probably wouldn't be able to ship it out until that thursday because I was pretty busy (was actually trading a computer + cash for his laptop), and he says that's fine and that he'll ship his out on Tuesday and email me the tracking number. Anyway, Thursday rolls around, I still hadn't gotten the tracking number from him, try to call him up but no answer, so I figured he's just been busy with his father and I ship it out anyway. Friday morning I get an apology email that his father had had another stroke so he wasn't able to get it out Tuesday, but he did in fact ship it out on Thursday, the same day I sent my stuff to him, but he didn't give me a tracking number.

That was the last time I've heard from him. I've called him at least 15 times, no response...the package I sent to him was due to him on Tuesday, so I figured the laptop would get here the same day since he sent it the same day I sent my package and we both used the same shipping method. Since I'd have to sign for it, I skipped class, but it never showed. I look up the package I sent to him, it did make it, but he wasn't there so it got rescheduled to wednesday.

So, wednesday rolls around, I had to skip class again so I could sign for it, but it never came. But here's the part that gets me worried, I looked up the package I sent to him, and he signed for it and received it. What's the big deal? Well, I called him at least 10 times Wednesday, on his cellphone and home phone, and left 4 messages and an email message, yet he never answered the phone or returned any messages, yet he was obviously home at some point because he did sign for the package I sent him.

Now, I'm quite understanding about his father and all, but what worries me now is that he made the whole thing up, because he DID say he sent it Thursday and he was home to sign for my package, yet he never returned any of my calls.

Did I just get ripped off?

Should I cancel the check?


UPDATE 7/29:
Ok, I took all of your advice and stopped the check. A few days ago, I received a notification from UPS that I had a package being shipped to me from New Jersey. However, it wasn't the laptop, it was my Dell.

He claims that he sent it back rather than the laptop because the check was stopped, however:
-he was SUPPOSED to have already sent the laptop, as we agreed to cross-ship.
-he SAID he had sent out the laptop last thursday, the same day I had sent out the dell, yet the dell had arrived in New Jersey on Tuesday, and by Thursday I still did not have the laptop.
-I called him, at least 40 times, on his home phone and cell phone, he never answered, he never returned my messages. Once, I was calling him every couple minutes, and he turned off his ringer to avoid my call.

So, I cancelled the check.

He sent back the dell, never contacted me, nothing. At this point I'm out $60 for shipping on the dell and stopping the check, so I give him a call. Finally he answers a call from me, so we start talking...

I ask him why I don't have a laptop:
he says because you cancelled your check, and then said I didn't hold up my end of the deal.

I told him he sent NOTHING, and thus didn't hold up his end of the deal. He said he was gonna send the laptop when he cashed the check.

I asked him why he TOLD me he HAD ALREADY sent the laptop on the same thursday I sent the dell:
He said he never said that.

I still have the email where he said exactly that, I read it to him and he started spewing off about the check being nothing more than a piece of paper again.

I told him I was out 60 bucks and being that my mom is unemployed, my dad is deceased, and I'm paying for college, I don't have 60 bucks to lose, and my next course of action was legal action. He then threatens me legally, saying I don't wanna do that, because if I don't let this drop he'll hire a lawyer and have me arrested for stopping the check because you can afford to do so and because it is a "federal document," or some nonsense.

Eventually, he hangs up on me. I call him back, he says "I'm recording this call, if you attempt to call me again I'll press charges for harrassment."

And I guess that's that.

Oh yeah, and did I mention that I called his local hospitals to see if they had any record of anyone with his last name having 2 strokes, and they said there was no one there by that name in the last 2 days, so, take that as you will, I suppose he could have been out of the hospital by then, but idk.

IMO, the check is already cashed. If you DID get ripped-off, he left for the check cashing place before he even opened up the envelope.

Good luck though.

Someone was obviously home. Not neccesarily him. It could have been the babysitter or next door neighbor or apartment manager that signed for it.

I would cancel the check fast as hell. Besides if you do ever get what he sent you, you can always do a wire transfer or such. If possible try and screw him first (before he can cash it), no court in the land would find you guilty for trying to contact him as much as you say you have... It is his responsibility to respond for sales. I have had my share of family difficulty in the past, there is no excuse for this though...

It gives the name of the signee, which was in fact him.

I'm at class right now, I guess I'll be cancelling that check as soon as I get out, wish me luck that this is all a big misunderstanding or that the laptop is sitting there when I get home.

if you use for sale forum trust heatware only
if you use ebay trust their feedback system only

if you have better ratings then he has ,you should have waited for him to ship first

i have 300 positive feedback on ebay but only a few on heat because of that when i buy/sell something on forums i pay / ship first

Uh, I would never ship before I recieve payment, regardless of their number of feedbacks vs. mine.

Nobody ever sends items before recieving payment based on feedback, that's just stupid. :p

I wouldn't say nobody. Iv'e seen enough posts where this was done and lo and behold the money never shows.

Seems like whenever someone sells/trades a big ticket item, a family member always dies/gets injured/etc.

If you don't get things settled and that guy lives in the NYC area, let me know and I'll visit him. I"m sick and tired of people getting scammed...

definitely cancel check; if there has been a mistake you can always resend.

contact police department in that city. talk to a person and give them background info in case you have to try legal proceedings. This may seem fruitless, but if you don't at least try then you close in important door.

Keep trying to contact person. I had similiar situation where the person was actually involved in car accident and we weren't able to communicate for 2 weeks. Things worked out in the end and he was very happy that i had kept the lines of communication open.

don't give out the person's name unless you're sure that you've been scammed; sorry but it's too easy to wreck someone's rep. If he deserves it, then no problem.

I cancelled the check, $31 fee to do so :(.

Kevin, he lives in Westwood, NJ, dunno if that's near NYC or not.

Contact the guys on this page. They're all members of AnandTech and have had great success in helping getting these types of things sorted out.

he wouldn't even respond to my PM.

I could have helped you out, even pick up the laptop in person if you want. You pay for shipping. I think he's about 30min away from me. Depending on traffic.

Yup, seems funny to me. Even if he couldn't call he could have had someone else do it. It's just courtesy. Let us know his nick if he doesn't respond within the next month.

true that. I wouldn't pay by cash or check anyway. I usually use a CC and go through paypal so I have at least 2 recourses in case the seller doesn't ship.

I called him a couple more times today, haven't left a message today though. Need an answer to this question first:

When I leave a message tonight, should I tell him I cancelled the check, or might that scare him off if he did actually intend to send?

you're not thinking very clearly about this.

No need to tell.

If you somehow do actually get the unit, you can just send him a check at that time.

Why does it matter to him if he gets the money or not? He already got YOUR company... If he's out to scam you, he's already successful (well partly).... Why would he suddenly decide NOT to scam you and send the laptop as promised???

He seemed more interested in the money than the computer...I believe that he did actually HAVE the laptop, as he gave me pics of whatever angles I requested on it.
