Yep, that's the law. The difference from obtaining the goods elsewhere along with any cost, time, and effort damages to obtain that item elsewhere are all owed to me if I have to go that route.

i remember when PS3 was coming out and i was trying to buy as many as possible to flip them. same with when the HP touchpad were going on sale for $99.

both of those times i had orders go through that ended up not being able to be fulfilled, simply because the demand could not be met.

what did they do? they refunded me my money and life went on. i didn't expect them to do more than that.
Except Troy is stating they did meet the demand and DSG didn't accept delivery. Pretty much the only out for DSG is lack of supply, which if Troy sues them over blows that one valid excuse out of the water.

You're comparing apples to oranges. Sure they are both roundish and fruits but not quite the same.

This leaves DSG in the position that they didn't fulfill the sale "because they didn't want to", which isn't exactly firm ground.

Hint: they didn't provide the $100 gift card because they were being nice, it's a payoff.

Other than admission to the Bar in 3 states, I totally agree with you.

PS - based on your behavior in this thread, I'd say it's mighty fortuitous that this firearm was not placed in the hands of someone like you.

Again with that logic fallacy someone else tried to use. Passing a test doesn't make you the end all authority on a subject. Now, if you would like to be responsible and actually cite a legal scenario, case law, or something else to that effect which would show I don't have a leg to stand on then you might have some merit to a post in this thread. But since you didn't you can kiss my ass like every other idiot in here.

Fortunately for me I do know the laws surrounding my scenario quite well. Based off your posts, I'd say I know it better than the average crappy lawyer that could barely squeak by on a bar examine in 3 states can muster. Or at least one claiming to have such credentials on an internet forum. In case you haven't realized, this is the internet and I can be as candid I feel like when it comes to slapping down people who pretend like they know what they are talking about, but don't post facts when asked. Instead, people like you try to use a logic fallacy to make their point seem more poignant. Corporate Thug tried the same thing with both an equivalency fallacy of trying to equate my sale with his newegg one, and then by arguing from authority.

But please, I'll give you a fair shot. Enlighten us O' Great Lawyer of the internet how my case would have zero merit. I would love to relay in such information to my lawyer. And if it's any consolation, to the lawyers already seeking co-plaintiffs off AR15.com as well. Please oh please I would love to use authority against authority here.
 
On a side topic, my BBB complain was certainly shuttled around everywhere. Finally ended up being filed in Pittsburgh, Pennsylvania.

Just looked it up, they are based out of there. Thought they were a new york based company from the "About Us" link from their web page. Oh well.

Been thinking the same thing myself. Someone gets this unhinged over a pre-order, who knows what they'll do when something bad actually happens to them.

The OP is a gutless bastard who is a tough guy online/over the phone.

I talk to at least 5 people like him every day. They act like spoiled children. They throw tantrums, threaten to sue, threaten to get me fired...all of it. When it comes down to it, they are cowards who wouldn't have the guts to do anything physical.

Its very common for these kinds of people to even threaten myself or our techs. This is when the fun happens. A supervisor will make sure the 2 biggest techs in their area go out to get the customer's equipment (yes we shut you off instantly if you threaten us or our techs) and the guy always turns into a sniveling child begging to not have his service taken away.

Fuck the OP and fuck everyone who acts like him.

Might want to edit that post. I believe under SYG laws, he now has reasonable right to kill you pre-emptively in 23 states.
