Dell is being sued by Dell

Paul has been summoned to appear before the Tribunal de Grande Instance Paris. Dell Computers is suing him -- not just to get the domain name from him, but also 100,000 Euro in damages to Dell America, 50,000 Euro to Dell France. They have also have ordered him to pay each Dell Company 40,000 Euro as well as 500 Euro for every presence of the word Dell on his site.

Dell claims he has committed acts of parasitism and of unfair competition to the detriment of the American company Dell INC and the French company Dell, and its commercial name: Dellhost as well as its domain names: dell.fr and dellhost.fr. I guess Paul is pretty scary to a big company like that. He has such an unfair advantage -- especially in size. 😉

he could've used any domain name ... and it was 2004 ... didn't he learn anything from the past to stay out of trouble ? I'm not saying not to fight it... but he didn't have to bring this upon himself to begin with. Hell, pdellwebsites.com would've probably kept him from getting sued.

Hey, he could just say "Dell is not a word, it's a NAME. Names aren't words."
It seems like court is all based on technicalities, well, that's certainly a technicality.

If you read the Register's article (linked to in the BlogSpot article), Paul Dell has owned the dellwebsites.com domain since 2001. Dell, Inc. wanted to buy the name in 2002, but he refused to sell it. So now Dell, Inc. is sueing for it 4 years later.

QFT, he wanted to use Dell's marketability to market his own companies services. Which are in closely resembling markets. Sucks to be him, but it wasn't a good idea in the long run.

dang this is stupid. it's not the guys fault that his name is Dell and he registered the site and has every right to own the site. Dell wanted to buy it and he refused, which he is allowed to do, and so now because they didn't get it, they're sueing him? i hope that all dell companies (computer) rot in hell. this is ridiculus and if that judge forces him to pay, the judge deserves to be, hell i can't think of a punishment strong enough for him. this is exactally like the Apple Corp. and Apple Computers issues. and i never knew that Dell Inc. delt in websites and i doubt that this guy sells computer. so i don't see what connection they have.

Well the guy is obviously using his name to generate extra traffic to his website. Like the Nissan thing. His website being nissan.com is obviously going to generate alot of traffic without any marketing costs.

Erm, his site was nissan when they were still Datsuns over here. Yeah, I'll name my website after my last name because its the same as some company half way around the world that calls their cars by a different name in the US to generate extra traffic.
