does the OP have the money to pay for the lawyer??? they arent free you know. to what end would this serve, he would still be out of a job either way and without a big payday which wont happen there is no purpose in suing.

If you have an EEO case, this could turn into a hostile work environment case(it may or may not be ripe yet), the EEOC usually litigates the case on your behalf if after their investigation they believe you have a claim. If a company fires you after the complaint, the EEOC will slap them with a retaliation complaint.

In the end, win or lose, he would likely cost the company a hundred thousand to a few hundred of thousands of dollars. That would be the purpose for pursuing it. Otherwise the assholes that work there will merely go on about their bigoted ways with batting an eye.

Write a few very politely worded emails to the boss about how the conduct is impacting your work life and perhaps even your health. Record daily life in the office using a hidden video camera. Write additional emails and become increasingly insistent about the need for changes. Start to bring it up around the office in public situations. It shouldn't be too long before they decide you don't fit in. Hire a lawyer. Profit.
 
Don't do anything until you've calmed down enough to think straight.

Then talk to your boss about it, face to face. If he's as reasonable as you think he is, he'll support you. And he'll respect you a lot more than if you have to hide behind an email.

That shit is unacceptable. Hopefully your boss will do something, if not, the new company won't tolerate it and will fire his ass quickly.

The threat is what gets the company to make changes. The purpose is to create change and to encourage other Bubbas to keep their mouth shut while at work.

Way too many people seem to adopt the "I go to work just so I can live my life when I'm not at work" attitude.

The problem with beginning your life at 5 (or whenever you clock out) is that you give up way too much control, quality of life and, opportunity to make your life better. Your attitude is no better than the companies who believe all they owe their employees is a paycheck. Both are wrong and contribute to the economic crisis America faces today.
