He, as an 'expert witness', can simply say you didn't yield (stop) for traffic, almost causing an accident. Probably has some quota to meet.

I'm coming back from my gym on the border of New Jersey and New York, about 30 mins from home. As i leave the gym, wanted to get some coffee before heading home as i'm tired and its raining hard out.

The road splits two ways, cars entering the road have to merge with traffic via a yield sign. Cars already in the road don't have to slow down as they have the right of way.

I'm entering the split via the yield sign, at least 5 cars in front of my all slow to 10 or 20 and proceed, I do the exact same thing, slow, check for cars and go.

I get maybe 500 feet into the road when a NJ State Trooper pulls me over. License, Insurance and Registration he says. I give him the paperwork without issue, i ask why did you pull me over, he doesn't say a thing.

Walks back to his car, come back about 15 mins later with a ticket. He says i'm giving you a ticket for failure to come to a complete stop at the yield sign back there.

At this point, i said, your joking right. He says, no i'm not joking. I said to the officer, may i step out of the car to talk to you.

He says no, doesn't give me a chance to talk. Makes me sign the ticket and walks off. I get out of my car anyway and he says, is there a problem.

I said, there is a huge problem, wrote down his name and badge and plate number. He says, why you writing that down, i said, to make sure i have your info on court date.

Rather than make a scene, i got back in my car and drove off, can't wait for court date as this ticket is total b.s. and i'm going back tomorrow to shoot some video of cars not stopping a a "yield" sign.

Cliff Notes: NJ State Trooper gives me a ticket for failure to come to complete stop a a yield sign.

I can sympathize: Redmond PD ticketed me for going 38 in a 25. Turns out it was a 35 zone, and there's no provision for ticketing when you're 3 MPH over. Still had to pay lawyer fees.

Honestly, if a cop is found to have issued a ticket that was wrong, they should have to pay all court fees and then pay for the lawyer fees required to go to court. If 10 happen in say 5 years, you're thrown off the force and blacklisted from any future law enforcement jobs. It's bullshit that they can cost people so much time and money with no consequences.

Then the ticket should say failure to yield to traffic. The language on the ticket is wrong, and can likely be thrown out for that alone.

Never get out of your car if they tell you not to, and his information should be on the ticket.

The actual incident is a bit unclear to me, but I've missed the point before.

Sounds like a gray area. Trooper merely has to state it was not safe to merge.
 
NJ troopers especially by all the bridges and tunnels have quota's . They try to hit the ny plates to meet them (palisades parkway to the GWB, us 1&9 to the tunnels, etc etc)

you probably have a NY plate.

This is quite a common occurrence and you will see tons of people show up to the little building they have for the hearing. NJ does absolutely nothing to discourage this. They look at it as tax.

Infact, if less tickets are written then usual, they will open an investigation, such as in Nassau County, LI NY
 
Weird, I've never even heard of such a thing. It's a yield sign, not a stop sign. Total grey area, I agree. I would be pissed, but what exactly are you supposed to do? The word of the cop may as well be the word of God. If he shows up, you better hope the judge is in a real giving mood, because you will not win.

Interested to see how this plays out though.
 
kudos to you for sticking to your guns and fighting this, but I dont think you'll win. Not because you aren't right, but because the judge will probably side with the cop over you. But I'd still go to court over it. That is BS

Wait for the spam mail to arrive soon from law firms stating they can help you with your ticket. NJ sells your info to law firms.

It's like watching a 15 year old give advice.
 
The language on the ticket is wrong and the cop LYING and saying "He almost caused an accident" is not proof of any sort. Explain politiely to the judge "I was carefully observing the traffic exiting the highway, slowed down and determined it was safe to proceed when I was pulled over."

If the ticket says "failure to yield" you are screwed. If it says "failure to STOP" you have a case as stopping is not mandatory for a yield sign.

Side note: The entire tri-state area can kiss my nuts. I left there long ago b/c of bullshit like this. Now when I get a ticket, I truly deserve it, dammit!
 
Cops word against yours in this case so you've got no chance. Best you can hope for is to get there early, talk to the cop about getting it reduced to a non-moving violation with a big fine to avoid points on your license. I'm pretty sure NJ and NY exchange info on points and this is a moving violation so your insurance will eventually find out about it.
 
Doesn't there have to be an accident for a failure to yield ticket?

Can you take a pic of the ticket and upload it? I'm curious of the exact verbage of the LEOs description as to what happened.

I've been pulled over -many- times (grew up riding sportbikes etc) and have never encountered a state trooper who would'nt have gone apeshit at you jumping out of your car like that. People have gotten shot by LEOs for far less, you're lucky you didn't see the barrel of his gun.

When I lived in NY, and had NY plates, I got pulled over on the NJ Turnpike for speeding (I usually go 75-80 in a 65 zone) probably 3-4 times (all pre-2003), and once for swerving (while changing a CD, trooper probably thought I was drunk as it was late on a Sat night). Since I moved to NJ (and got NJ plates), I drive on the Turnpike a lot more, at more or less the same speeds, in the same car and I have been pulled over 0 times. It might be coincidence, but I think you can make a case for getting the benefit of the doubt when you have local plates. 😉
