Whatever you do... DON'T do that. While its morally correct and the bastard deserves it, it could be considered defamatory and you could wind up in a heap of trouble. If you're going to take it down, just take it down.

If you have a decent contract, and the guy has some assets, you'll be fine.
If you have a decent contract and live in the right state you'll also get him to pay your lawyer bills.

You need to take him to small claims court (make sure the $ amount applies, ie if he owes your $5000 and small claims only maxes out to $3000, find another way).
Put his site back up now, but you must take him to court.
He's crazy to say that he will sue you--wtf, he never paid you!
Like you said, he can't be trusted, so you have to force him, via court or whatever. I wouldn't give this guy one more chance--if you do, you're a chump and a sucker.

I'm no chump but do feel like a sucker to get in this type predicament. I was thinking about it over the weekend and just put his site back and take him to small claims but he changed his passwords so I can't get in any more. Oh wells I tried. Either he is planning on getting a attorney to sue me or hiring another sucker to do his website for him.

I have not, but we have been told by several sources (lawyers and an accountant) that this is an effective way for a contractor to resolve payment issues with clients that don't pay their bills. The IRS would consider any work for which they did not pay to result in additional unclaimed income to the deadbeat.

interesting. i've never heard of this one. it's worth looking into.

If he is in violation of the contract, do not put anything back up until you get 100% of the payment. If you do put it up, he can probably rip all the data.
