It depends. THey could bring some BS lawsuit against you for hostile actiosn or soemthing.

Obviosuly they would be wrong but if their lawyers outlast yours...well you know the rest

I'd go to small claims court first. If he doesn't pay, take the site down.

Well it's a work for hire, and he never paid you, so I guess you'd still own the copyright... But really you need to get paid, because that stuff use worthless to you. Small claims court it is.

Yes he did and he defaulted on that. I gave the guy a extension and still defaulted. He then wanted an installment plan and I said sure as long you pay. And he never came through on a installment plan for me.

Hack'em and hold the site hostage....for what they owe you, plus a penalty for them being stupid.

Conveniently link their site to hate groups, porn sites...hate group porn sites, etc.

Tell them "The beatings will continue until your check clears, fcktards."
 
That's when you freelance you break the payments into 1/3's. So if they don't pay you then at least you 2/3's of it. Better than nothing right?

No. "Your rights" a lawyer can tell you about. I'm telling you what they morally owe you. 😀 AFAIAC, people who welch on debts are fair game for all kinds of retribution.

I would take the website down...and report them to the BBB. This gets into Intellectual Property and all that other bullshiit.

This is kind of like child support. Just b/c the guy doesn't pay does NOT mean the woman can legally withhold visitation. Should she? Maybe....but that's what the lawyers get paid for.

What you could do (and stay in the clear b/c you're not "witholding" anything) is leave their site up, but totally screw up the pages. Every single one. Porn links. Link to competitor's sites, etc. Claim complete ignorance...and smile at the owner when you say it. He'll get the hint. You'll be surprised how well Polite Coercion works.

After you get paid, kill the site anyway. He deserves it.

 
this is why i ALWAYS get paid 50% of the total cost at contract signing
20% at approved spec
25% at final site
and 5% when it goes live
 
Do you have a contract? If not you're screwed. If so...the pages are copyrighted to you and you can do whatever you wish until you are paid to transfer copyright or permit use of copyrighted material.

If you have a contract and have the ability to take down the website - I would do so.

If you don't have a contract....I would probably still do it and then give the guy a phone call right then and say it will be offline until payment in full is received. If they want to make it a legal battle...you may have to put it back up for a bit but at least I would do it in the first place.

I WOULD NOT put something up like a "payment notice" or anything like that but just a generic under construction page that says there are some problems being worked on or whatever. If you post anything bad about them it could come back to haunt you.
 
ivce seen this happen more and more lately...getting jipped when it comes time for payment for web work...its like people think says its up and done they can get away with not apying you or putting it on their "to-do" list and leave you waiting...
I am in the process of figuring out how to go through small claims court. Unfortunately across state lines its a bit more difficult and costly but its the route you have to take.

From now on i deal primarily through rentacoder, so that way payment goes into escrow, yeah they take a chunk out but at least it means i know i will get my money.

Thanks for the advice. I do have a contract with them with approval of work to be done. But I didn't state that I will take down your website if no payments was recieved. I never anticipate this happening. But since he agreed to the contract those are still my files.
 
I wouldn't take it down or anything like that. If you already sent them a letter threatening legal action, sue them. That's your best course of action imo.
