.11n has been finalized since 2009... Both of these routers are draft .11n and really, why not play it safe and buy one that isn't draft?

Because some of us are thrifty (cheap-ass) and still running WEP routers :)
For $13 might as well go for the "upgrade"

But I am wondering is .11n "draft" to .11n "final" just a s/w vs h/w difference?
and will installing DD-WRT upgrade it to .11n final?

There is no hardware difference between a draft 2.0 11n router (this) and "final" 11n equipment.

Draft 2 11n works fine with Final 11n. NEar as I can tell, without any throughput issues, as well.

Got it in today ...went from a paltry wired download speed of 22 Mbps to a blazing 25 Mbps :)

Upload stayed same @4.2 Mbps

Haven't installed DD-WRT yet
