So if it's documented on video, how is he not being punished for something or other?

that's a good question

that lady said she was gonna call the cops but it didn't look they showed up

He was being a jackass, but the other guy assaulted him first. Technically he was defending himself.

Technically he used excessive force. What exactly is defensive about hitting someone who is on the ground in the head with a skateboard, or kicking him while he's down?

making sure that he didn't get assaulted again

That guy was an ass, and he was trying too hard, but it was amusing.

I kinda have the feeling the lady was bluffing about calling the cops.

That's a bunch of crap. The guy was clearly in no position to retaliate after the first shot to the head. If you've ever been cold-clocked before, or have someone throw a cheap shot at you in a bar, you know the feeling. And this is with a skateboard no less.

Show that video to any jury and you easily have a conviction for assault and battery. Hell, you might even have a case for attempted murder.

This is why you should own a gun.

Honestly, it probably would not have done any good in this situation unless he had de-holstered it before the first shot.

If you take a shot like that, you can barely walk, let alone discharge a firearm.
