Damaged 8800gt?

I bought my Asus 8800gt from newegg about 2 weeks ago and for the last 5 days it has been nothing but problems. What happens is when I load certain games like Crysis or Assasins creed I get corruption for around 5 seconds or so and then I get a bsod with the "page in non paged area" error. I checked my ram with memtest so it's not that. I also used a program called videomemorytester that checks your v-ram and it passed that ok.

The thing is certain games run perfectly such as Wow, Prey and recently I have been playing Lego Indiana Jones without any problems. I'm not sure what to do, if anyone can help me in any way I would appreciate it.

e2180@3.4ghz (tested at stock as well so this is not the problem)
2x1gb Gskill pc6400 ram
antec 550 watt
 
Well, you can get 3dmark (old one) to test the video card. Or you can try this card out in your friend's rig. As a last resort, do a clean install of windows. Make sure you back up your stuff.
 
Just ran 3dmark2001 and got a score of 41561, test completed perfectly. Last time I remember running this I was trying to get 20k lol.

Whatever the problem is its getting worse in Assassins creed. The artifacts and such now happen on the loading screen which I find weird.
