I talked to the insurance company of they guy that hit me back on Jan 21. (See here)

They claim that their guy does not remember anything about the accident, and is still in the hospital. So at this point, they cannot assume any liability for the accident. Meanwhile, at the Ulfwald household, I am stuck at home, losing time from work, racking up medical bills, drug bills, and still have no transportation.

I now have a full copy of the police report with witness statements that he rearended me, knocking me out of control, and that I was in the lane of travel for at least 5 mins before he came off the entrance ramp like a bat out of hell and made almost a perpendicular line all the way over to the far left hand lane where he hit me.

This guy had better "remember" what happened real fast if he does not want me to come directly after him for this crap I am having to put up with.

**UPDATE**

Well, got a call from his insurance company, this time a much more professional and pleasant guy to deal with. He is meeting with me tomorrow to discuss things, go over the police report, etc. He wants to settle this thing real fast on the property issue, but he realizes that I will not settle out on the medical until after I have been released from the Dr. He actually apologized for the way the previous rep handled things, and said that this is not the way they do things.

Looks like I am going to be ok on this without having to deal with a lawyer.

That's ridiculous. Pretty much any rear end collision is automatically the rear-ender's fault.

as long as you have the police report and it states that you should not have anything to worrie about. Sure they aren't going to greet you with open arms, but they will pay in the end.

Either get your Ins Company working on your behalf, or talk to a lawyer and see how much you can get out of if for Pain and Suffering, lost wages, etc. And then get them in court so you can win big and retire.

Don't let them get out of paying everything. They should pay rental, loss of wages, repair for the damages to your car, your medical bills, etc..etc..
I was in a wreck a few years ago, and the insurance company tried to screw me out of the rental car and tried to give me half of what my car was worth (it was totalled). I had a friend, who used to work for the same insurance company, call them up and lay it on the insurance company heavy, she knew all the tricks and sh!t these guys would pull. And she was a stone cold b!tch when she called. The guy was so pissed off.

This is why you pay for insurance. If HIS insurance company won't process the claim you handle it through YOUR insurance and they go after the other insurance company. You are out your deductible until they settle.

get on the ball and start harassing your insurance company to get theirs to pay. who cares if the other guy was knocked senseless. in my experience, it is pointless to deal with the other guy's insurance directly because they will just brush you off until you give up.

My Ins. company is more than willing to take them on for me. But I am the one telling them to wait. His Ins. company just got the police report friday, so they are still doing the investigation. But d@MN! I got hit in the azz, they should know that in GA the rear ender is always at fault.

you need to get a lawyer. a really good, "larry h parker got my one million dollars" type of lawyer. His insurance company is trying to screw you, and you need someone who can screw right back.

The only thing Ulfwald's and Lucky's scenarios have in common is that they both involve cars hitting each other. Otherwise, Ulfwald's was far more serious, taking place at freeway speeds. He's lucky to be alive in my opinion. Also, from what I have read, Ulfwald is just looking to be compensated for his actual losses, and not seeking to profit from the situation.


Ulfwald, if the other insurance company just got their information on Friday, it will take a few days for them to process the investigation and begin awarding the claim. This is, unfortunately, normal. My advice is to be persistent but patient. Call them and your ins. co. every day to remind them of the urgency of your claim, but realize that this will probably take at least until the end of the week.

Reason I am telling my ins company to wait is because I do not want a claim on my insurance.

Reason I am not hiring a lawyer just yet is because my father is in the insurance business, he will get involved in this if need be, He has done a lot of work in Ins Fraud, worked closely with the Ins. Commisioner here in Ga. So he knows how to bring the big guns with it costing me anything for a lawyer.

If the guy in the hospital is on the police report being listed as the driver, it doesn't matter if he can remember or not. With his name on the report it shows he was driving. Get a lawyer and go after him.

a claim on your insurance that results in the other guy's company paying 100% does not affect your rates, unless your insurance company really sucks.

Have you at least filed your medical claims under PIP (Personal Injury Protection)? It will not raise rates and the other insurance company reimburses you for using it.
