Long story short...busy off ramp. You stop, look and then go.

Pulled up behind a dude who had a clear shot...he went. I get up, stop look for oncoming, still clear...go. Maybe make it 10 feet to find him stopped in the traffic lane with no reason. He just slammed his brakes.

Anyway the impact was more pushing than a hit. I was maybe up to 20mph if I was lucky. He was already on the phone and kept calling people. I had to walk up to ask him to pull forward so I could get out of oncoming traffic.

He just kept calling. Three different police (two border cities and the state), about 6 emt/fire rescue/ambulances. I just had a bad feeling.

He insisted he was in major pain, his daughter? was worried she was going to be late to something...his wife was asking weird questions/etc like when I was trying to get my car drivable "wouldn't it be better to leave it damaged?" just a bad feeling i got.

I get home and look up on our county's court system.

Guy is 67 years old...has a felony drug conviction, eviction, charges of beating his wife (with both listed as indigent), he is on a payment plan for a criminal traffic infraction as of last month (which was $400, he has to pay $30 per month). About 5 other traffic infractions over the last few years.

His wife has interesting stuff too?being sued by capital one, sued by providian, also beaten by her previous guy who she tried to have baker acted, also has evictions.

This is probably going to be a mess.

My car is messed up...with a radiator it would be fine to drive probably (I made it about a mile driving home with it). There car probably could use a new exhaust and rear bumper cover...my car is so low it didn't hit the major parts of the car so much, but it just sort of acted like a ram against the soft sheet metal of my car mangling it.

I am thinking they maybe looking at me as a lawsuit out of trouble.

Smells like a setup.

With most states laws of "if you rear end someone its your fault" it leaves open the possibility of people like this stopping short to create an accident which is automatically your fault.

I really don't see what any of that has to do with the fact that YOU hit them...and rear-ended them at that. You're fucked if they choose to sue. You'd better hope they don't get themselves a GOOD personal injury lawyer...

Normally I try to be sympathetic in these situations, but this sounds about right unless the OP left somthing out.

Regardless of ATOT's opinion, its his fault according to insurance almost no matter what.
 
definitely smells fishy. Does your insurance policy provide protection if you get sued? And was it noted that he just slammed on his brakes and stopped for no reason on the police report? Did it look like he was injured at all, besides him complaining of 'major pain'?
 
I hope I'm wrong, but all the evidence points to a insurance scam. They intentionally stopped hoping you'd be too distracted looking for oncoming traffic to notice they stopped. That and the odd behavior doesn't sound good.
 
I did the exact same thing a number of years ago. The guy I hit was really cool about it, though. He took my insurance info, said he would get an estimate, and if it was not too much I could just pay him. $100 and no drama later all was well. Good luck to you, sounds like you'll need it.

All the other guy has to say is that he stated to proceed, realized it wasn't safe to do so and stopped. That puts ALL of the fault right back in the OP's corner. Doesn't matter whether there was a legitimate reason to stop or not, just by stating that he didn't think it would be safe to proceed, (possible traffic moving faster than he thought) he has made the OP responsible for the accident.
COULD it be a scam? Sure, they happen all the time, but not usually in this manner.

I will agree...safe following distance.

Here is the thing, the left lane had the arrow. That means no one is coming from the left (usually).

He was stopped as I pulled up, I almost blew my horn at him to go. He took off when I stopped behind him. I pulled up as he was still going, stopped, looked left and went. He then stopped dead in his tracks while fully in the lane. I maybe moved 10 feet after that.

I know it sounds like my fault...but I think I was set up for his profit.

Actually this is a textbook case. Take off fast expecting the guy behind you to now not even think you will still be there. I am not sure what you are trying to get at.
