then changes facts to present to a Florida Grand Jury.

WASHINGTON - In a sharp rebuke, a federal appeals court denied Wednesday a Bush administration request to transfer terrorism suspect Jose Padilla from military to civilian law enforcement custody.

The three-judge panel of the Richmond-based 4th U.S. Circuit Court of Appeals also refused the administration's request to vacate a September ruling that gave President Bush wide authority to detain "enemy combatants" indefinitely without charges on U.S. soil.

The decision, written by Judge Michael Luttig, questioned why the administration used one set of facts before the court for 3 1/2 years to justify holding Padilla without charges but used another set to convince a grand jury in Florida to indict him last month.

Luttig said the administration has risked its "credibility before the courts" by appearing to use the indictment of Padilla to thwart an appeal of the appeals court's decision that gave the president wide berth in holding enemy combatants.

Padilla, a former Chicago gang member, was arrested in 2002 at Chicago's O'Hare Airport as he returned to the United States from Afghanistan. Justice and Defense Department officials alleged Padilla had come home to carry out an al-Qaida backed plot to blow up apartment buildings in New York, Washington or Florida.

Yes, it is. But, doesn't it keep the door open for an appeal to the SCOTUS instead of going to trial over the "charges"?

Can prosecutors appeal up? I thought it was just the person defending?
 
That's what I meant. Padilla appealing to the SCOTUS to be released as he's an American citizen and been held w/o charges for over 3 years. And now that they slap on charges, it doesn't fit the facts the gov't has been pushing for those 3 years.

Yes, he does. The court isn't allowing him to be moved over to civilian custody on charges unrelated to the stated reason for his captivitity. There won't be an easy out that way, at least not along these lines.

Probably more likely they'd have to reveal the bogus information they were using to hold him.
 
Notice that the opinion was written by Luttig- very conservative and very influential, described by some conservatives as the "dream judge" during the whole Miers imbroglio...

If the full appeals court upholds this ruling, then the Admin is likely to have their ass handed to them at the SCOTUS level...

Bait and switch may work at the electoral level, but it doesn't seem to fly in the court system...
 
Interesting... finally we got to the point where judicial system is pointing out the flaws in the "anything to protect from terrorism" authortity. I forcee SC cases coming up - good.
