COURT DATE

alright i was pulled over a few months ago for going 82 in a 65 zone. my court date is February 13th (next tuesday).

the vehicle i was driving ('97 Mazda Protege) cannot safely go at that speed. after 75 it violently vibrates. aside from this and the fact that the officer was tailgating me with no lights on at night (making me scared someone was chasing me), is there anything i can state in my defense?

i will update the original post as needed. any and all help would be wonderful.

btw, traffic school is not an option

EDIT: i live in Davis (Yolo County) so the cops here don't have better things to do than give tickets. i doubt a court date change will result in a no-show on the officer's part

if i was in an area that doesn't write "enforced by radar," can the officer use a radar gun?
 
you might as well say its impossible that you were speeding because at 66 mph your wheels fall off. you'd be better off because perhaps you might make the judge laugh hard enough that he dismisses the case on excuse originality.

not a bad idea 😛 . ok the car is getting real old. it's a mazda and has like 170K+ on it. so at taht time it could go almost 80 safely...now it can't. so maybe if i say after 73 it shakes violently it would be better?

also, is it possible to bring the car in as a "witness" and prove this to the judge?

i'm not sure who she is but i'll try and say something like that 😉 . i want to be able to word it in a way so the judge doesn't give me a hit for reckless endangerment or something like that though...anyone good at writing in here??
 
Okay, the gambling thing to do is to call the court and reschedule the hearing date. Police officers are very busy people and might not have the time to show up for court hearings, unless it's a major case - murder, rapes, abuse.

ok i'm going to add this to my OP. i'm in Yolo county (next to Sacramento). the cops here give tickets to BICYCLES for speeding. the cops do have time for court dates. thanks for pointing this out CocoGdog
 
You could TRY and tell about how the car wasn't going that fast b/c bla bla bla, but in general, judges almost always take the officer's word over yours. That's the way it is.
Your court date might only be for you to declare if you are *not* guilty, and then will be given another date.
Basically, the odds are that you will be wasting your time if you try to be heard in court.

alright, that's good. can anyone help me develop this? it's not like i can just go up there and say 2 sentences and sit back down lol

Yeah... that's not going to fly.
 
ask the police officer if he calibrated his speed measuring device at the beginning of his shift. If he says yes, ask him to explain in detail how it was done.

Before then, study up on proper protocol in your state to calibrate the equipment. If he fails to explain it correctly, there is no way to tell if the equipment was calibrated, hence no way to know if the speed given was correct.
