Copyright violations .... what about image thumbnails?

Suppose I write a script to create a thumbnail image of any image link given to it, is the image returned a copyright violation? If I had it on my site, would I be responsible if users went in and created thumbnails for copyrighted works?

In 2002, a federal appeals court ruled that Web sites may reproduce and post "thumbnail" or downsized versions of copyrighted photographs. Nevertheless, it said displaying full-sized copies of photographs is a copyright violation.
