I havent seen it so I dont know, but it us a matter of a personal oppinion what counts as a beating and what doesnt, right?

apparently, as i saw both the videos and they were both beatings in my book.

Officer beats/abuses suspect. Suspect sues jurisdiction. Residents of jurisdiction pay more taxes to offset the loss of revenue due to fighting the lawsuit and maybe paying the award from the court.

This is in addition to what it does to the Officer and their family, morally and financially!

From a legal perspective I think that the cop should be repremanded and/or taken off the force. It's not setting a good precident to allow things like that to happen.

But, from a personal perspective I don't have much of a problem with a "hard arrest" of some asswad who just put a bunch of people in danger, including the cops.

Yeah, but that guy didn't need to get beat fervently with a MAG flashlight when HE put himself on the ground.

It's not the cops job to pass judgment and beat the guy when he cooperating. I understand there was a car chase, but the guy laid on the ground, and about 4 people were on top of him while this other cop beat him... What's up with that?

Let me ask you a question.

At that time. Were the cops in danger?

We both know that the point beyond reasonable use of force is Battery. The intent of the officer(s) at that point is the issue (IMO). I'd consider any touching of my person beyond that which is necessary to effect the arrest to be Battery. I viewed the video or two videos and my view is that Battery on the 'suspect' occurred. The Officer should be charged criminally and the city and individual should by open for Civil Tort action.
