No it's not. Here are the offenses listed in the police report:

F.S.S. 800.04 Lewd or lascivious offenses committed upon or in the presence of persons less than 16 years of age.

F.S.S. 800.04 (4)(a) Lewd or lascivious battery is when a person engages in sexual activity with a person 12 years of age or older but less than 16 years of age...

16 is the age of consent in Florida.

Often times while the age of consent is 16, you can only be a couple years older to still be legal. For instance an 18 year old could do a 16, but not a 19 year old. After 18 though it's all fair game for anyone older.

so if he is under 24, he would have got away with it.

If she was actually 16 like she said she was, he would actually be fine in the eyes of the law. The person who lied and therefore caused the "crime" to occur is the girl. Age of consent laws are tricky. The fact that she admitted to lieing makes this a pretty shady case.
 
this strikes an eerily familiar chord. I went to FAU and knew this, umm "friend" who may have umm had "adult relations" with a high school cheerleader during his freshman year at FAU. And that's all I'm saying, Mr. Hansen.
