Collection agency wants check over the phone, should I?

I came into some money, and I am trying to settle an old debt, but the collection agency I am dealing with wants me to give them a check over the phone. We have reached a settlement amount that is $800 less than the balance, but I have read that if you give the collection agency a check over the phone they can use it to take the total amount, and there is nothing that you can do about it because you owe it in the first place. Anybody have any experience with this?

If you agreed to a certain amount over the phone, I think that qualifies as a verbal contract... so, they would be bound to it. I could be wrong, though.

You tell them to send you a letter stating the agreed upon stettlement amount and that this amount will settle the account as agreed and that you will then send them a check !


You want it in writing, don't give access to your bank account info over the phone to any
collection agency !

Don't do this. Oral contracts are not valid in all states, and usually don't hold up well in court anyway.
Do what Baffled2 said. Get them to send you the agreed upon settlement in writing, then mail them a check. The fact that they have agreed to settle for so much less and that they insist upon the check over the phone only tells me that they have every intention of screwing you.

I wouldn't feel comfortable giving check over the phone and I'd rather write it and mail it to them. At the very least, tape record the conversation, with the other party's permission.

The entry "pedestrian" wasn't even my problem. It was a near miss accident a friend had when some stupid pedestrian ran in front of his car.

Giving your checking info to an unknown party can be dangerous. I have done it with the phone company a couple of times, but I would not do it with a collection agency.

If you don't already have a statement or invoice you can use, ask them to send you one. When you receive it, write a note on the check saying something like, Payment in full for invoice #xxx. Cashing the check constitutes acceptance of the terms of your memo.
 
They are encouraged to get the check over the phone so they don't need to wait (and wait, and wait, and ...) for your check. They sure are cynical bastards.

If you're worried, just mail the check and tell them that it's in the mail, and if they wait 3-4 days, they won't ever need to call again. They'll have no choice but to wait a few days, but they'll get their money.

First of all, they weren't "going after me", I voluntarily picked up the phone and called them. Secondily, if I wanted a lecture from some anonymous internet jerk, I would have asked for that in the original post.
