Not their responsibility. People with substance abuse problems need to be thrown away by society so they can learn the true costs of their problem and choose to either get clean or perish. Holding their hands and telling them the PC POV that it is not their fault is a bunch of BS. Almost every person I have ever known with a problem that got help eventually CHOSE to let the monkey on their back once more. I no longer have sympathy for people who chose to be self destructive.

An arrest for possession of illegal drugs is all the EVIDENCE they need to terminate her. What part of most companies drug policies are people not able to grasp. Using drugs anytime....even on your own time is enough to justify termination. A company doesn't have to prove you did it at work. If you show positive on a random drug test you can be fired immediately, even if the drugs in your system were used on a cruise ship in the middle of the Carribean on your vacation.

the other information he has posted is NOT public information. It's in bad taste IMO o post an individuals public information to a site like this. Until she is proven guilty, she is still innocent legally, and he could be guilty of libel by connecting the two.

Write a new clause in the company policy stating any use or posession of drugs and/or drug paraphernalia is grounds for termination.

You guys have an at will employment policy? I had to sign something here to that effect, the HR manager explained it pretty well. Basically they can fire me or I can quit for any reason, no questions asked.

He said that if they didn't like the color of my socks they could let me go =P

Be careful in firing her. My place of employment can not fire someone who is actively getting treatment for an addiction. An addiction is considered a disease.

that being said, she'd be gone in 60 seconds if I had the power.

He doesn't have legal evidence of her using illegal substances on company property. Thus his questions as to their ability to fire her arbitrarily. I think it'd be nice to give her a chance, but it's not my biz.

I know you are on some sort of anti-drug crusade but wrong place at the wrong time does factor in sometimes. A friend of mine got nailed with a possesion charge because one of his other dumbass friends had a small bag of weed on him (my friend was being nice and just giving the guy a ride home).
