the facts:

the woman got arrested 2/18 for felony possession of cocaine.

We are stuck with a situation now, we (the owner and myself) have suspected her for a few months now of doing drugs in the bathroom here (She goes to the bathroom like 20 times daily). Well this arrest pretty much confirms our suspision (sic?). Does anyone know right off the top of their heads if this arrest is enough to warrant her termination? She is already on probation with us for overextending her lunch hour, not coming back from lunch at all and just not showing up to work. She has done good with her attendance once we told her she is on probation, but now we simply do not trust her (and she is in a position to rob us blind) and want her gone. I am worried if we fire her before she is proven guilty then she can sue us for wrongful termination.

Depends on the contract. Most employers can let ppl go "without a reason."

Depends on the contract. Most employers can let ppl go "without a reason."

Letting someone go is different then firing someone.
 
Florida's "Employment At Will" Doctrine

Florida employment law is based on the general rule that any employee may be discharged by the employer, or may leave the job, for any reason whatsoever, or for no reason. In other words, an employer in Florida may hire and fire any employee at any time for any reason. It doesn?t matter if there is no reason, a bad reason, a good reason, or just the result of a whimsical decision. Likewise, the employee is free to quit a job at any time without any reason and without any notice. THERE DOES NOT HAVE TO BE ANY REASON FOR FIRING OR FOR QUITTING. This is referred to in the law as the ?Employment at Will? doctrine.
Contact the Florida Department of Labor and Employment Security for confirmation, but it looks like you're set to fire her for this if you wish to do so.

Chances are you can fire her for any reason or for no reason at all. You could've fired her before she was arrested if you wanted to. It's called "at will" employment.
 
Let's see.....you are in question over whether you can fire someone for illegal drug possession and use AT WORK. Damn you must be a liberal. Can the beotch....she has absolutley no recourse or legal leg to stand on. Even if you could not prove she had the stuff at work (we all know she did...that is how junkies are) it doesn't matter. Most companies have a drug policy and ANY use at ANY time is enough to justify termination. Hell, if there is no union you can terminate her because you don't like her...unless she is Black....then you are stuck with her FOREVER.

My wife, who has worked in Human Resources for several years would say, "Document, document, document." It's as simple as that really. Hell, I worked for an employer that would fire you if you got a DUI driving your own car on your own time and they saw it in the newspaper. Ensure that you document everything, including the latest information on he arrest, regardless of how you came into the knowledge of it and fire her for it.
