That is a national or Florida state law? Do you have a link? I don't doubt you, but just curious since I was pretty sure it was this way in Kansas too. I always hear the radio commercials that say"if you get pulled over and you're not wearing you seatbelt, you could get an additional fine...."

Yeah, and they say that sober people get more injured than drunk people in certain types of accidents, since they tense up. Still a pretty contrived reason to drive drunk.

I can buy the lack of concern for your safety if we're talking about speeding. But considering that they have to scrape people off the pavement who would have gotten away with just bruises, and that taxpayer money funds the treatment of a lot of people who wouldn't have gotten injured if they'd buckled up, I'm not about to argue the seatbelt law.

How about this: You are free to not wear your seatbelt, however, in the case of an accident you will be billed the estimated difference between the cost of your accident (police response, medical units, airlift, medical care, towing your car now that there's no driver), and the cost of the accident if the driver had been belted.

In those exceedingly rare accidents you mentioned where being buckled up causes more injury than not, you get a check for the estimated difference.

It's state funded information gathering. A best case scenario is that they get to ticket someone and generate revenue for the municipality in which they are working.

I would have asked the officer why he was taking your drivers license number down. As politely as possible of course.

I actually knew a guy who was involved in a relatively minor accident in which he slid off a road into a tree, however he was trapped by his seatbelt & burned to death when his car somhow caught fire & he couldn't get out.

Having said that, aside from trapping you in the car I can't think of any way having a seatbelt on would result in greater injury & I always buckle up as does anyone riding in my car with me.

Yes, states can set their own enforcement of this law.

The wasted resources of law enforcement personnel for seat belt checkpoints in disgraceful. This is a situation where any alert driver encountering a slowdown for this reason can quickly snap on his belt and be in compliance.

Do seat belt laws specify lap and shoulder restraints? What if you had a seat belt on but it appeared to an outside observer that you were not buckled up?

I don't know about Florida but in Virginia they cannot issue a seat belt ticket unless they are ticketing you for something else such as speeding, tail light out etc. Whether or not they can pull you over just because they see you not wearing a seatbelt is obviously open for interpretation since they can pretty much make up whatever they want as the reason for stopping you in the first place.

Don't worry the nanny staters who are nothing more than a modern version of the puritans will just toss you the old "it affects all of us because it affects insurance rates" argument if all else fails to justify their nannyism. We should all be grateful that there are people that are so complete in their lives that they have nothing but time on their hands to worry about everyone elses lives and well being. They will not be completely satisified until they have us all living in hermetically sealed bubbles protected from everything in the world but no doubt when that day comes they will find some chemical in the bubbles material that is causing us great harm and start worrying yet again.
