Classaction: refund for viewing Sony Movies = $5 compensation

The class action lawsuit alleges that Sony Pictures Entertainment Inc. (?Sony Pictures?) advertised Hollow Man, Vertical Limit, A Knight?s Tale, and The Animal using quotations attributed to ?David Manning? or ?Dave Manning? and incorrectly indicated that Mr. Manning was affiliated with The Ridgefield Press; and that Sony Pictures advertised The Patriot using endorsements of persons who were its employees without disclosing that they were its employees.

To make a claim, you must sign a statement under penalty of perjury under the laws of California and of the United States that, between August 3, 2000 and October 31, 2001, you purchased a ticket to and attended a United States theatrical exhibition of Hollow Man, Vertical Limit, A Knight?s Tale, The Animal and/or The Patriot.

Class Members will be paid a maximum per-ticket claim amount of five dollars ($5.00) out of a total Claims Fund of $750,000 such that all claim amounts will be proportionately reduced, after deduction of administrative costs, if Class Members submit claims for more than 150,000 tickets.

I always wondered who those "reviewers" were that said such great things about crappy movies that I've never heard of. I just assumed that they made them up.

$750K total pool / # tickets claimed ($5 is MAX)... site seems to be getting hit hard too. So they'll probably be a million or so tickets claimed... $0.75 here I come!!

If it gets to be less than $1.00 per claim, then nobody gets anything and 100% goes to charity.
In the event the total number of payable claims exceeds an amount such that the majority of claimants will receive less than one dollar ($1.00) per claim after deducting cost of administration, then as a result of the de minimis nature of distribution in comparison with the total cost of distribution ($1.50 per claim), the entire $750,000 shall be distributed as a cy pres payment to a charity to be approved by the Court at the time of the final approval and no payments in any amounts will be made to Settlement Class Members.

With the thousands of newspapers and magazines that do their own movie reviews, it's usually very easy to find 3 nice, short, complimentary quotes to put in a trailer.

Apparently that was too hard for Sony for those movies 🙂

Bet the (word omitted for the sake of humanity) lawyers will get paid though. Bet they're not going to give their "share" to charity.

And why should they? Do you give money you earn working to charity? I'm so sick of this 'omg teh lawyers are gettings teh moneys, boohoo' attitude.

Back on topic, too bad I didn't see any of those. Wonder what charity the judge will choose.

Yes I do (and I actually produce something of value not redistribute money for a living). Apparently you must not or it wouldn't seem like such an outlandish idea to you...

Lawyers... earn... That's a good one... ROTFLMAO!!

BTW nice move on the lawyers' parts... They get $500,000 while the class gets $750,000. So out of a 1.25million award they get 40% Sweet deal for them.

This instance is good, but my dad had two settlements one for DirecTV and one with AT&T and both times the lawyers get paid money and customers are stuck with coupons. Coupons that were only good it you bought more from AT&T and DirecTV, that is when a lawyer should not get paid.

I propose a lawyer has to be paid in the same currency as the victims.

So you give everything you earn back to charity? Don't keep anything for yourself? Maybe you are mother Theresa and you live on rice and water and give it all back. You produce something, and people who work in service industries are just redistributing money and therefore shouldn't get paid? I do give to charity, not alot as I don't earn alot but something.

As for earning it, of course they earn it. Any idea how much work a lawsuit like this probably required? Its not one guy spending a couple hours on lexis nexis and 10 minutes in front of a judge...

So basically since what Sony did affected a lot of people the lawyers shouldn't get paid? They should do it out of the kindness of their heart? Or more likely if they weren't going to get paid for persuing it Sony would have gotten away with what they did. So if we stop paying lawyers for class action lawsuits then all a company has to do to ensure they don't pay for their mistakes is to allow those mistakes to affect many people. Or maybe let each individual bring it to court, tie up the system with thousands of smaller cases.

Two things I do agree with 1) the lawyers cut was a big chunk but then again I dont' know exactly how much time was dedicated to this case 2) JimKiler's idea of paying lawyers in the same currency as the settlement does make some sense (if the lawyers agreed to only be paid out of the settlement).

Why am I not seeing a claim form? When I click on their link, all I get is an email being sent to them...

thanks 🙂

and on another class settlement boondoggle for the claimees(didn't even know I was a "claimee" 🙁 )
Blockbuster giving out coupons for non-new release free rentals and $ off non-video purchases for members of a certain date range(not sure as I gave the stupid paper coupons away forthwith ) as part of a settlement ...I should have kept the paper for posting here 🙁

I think Wild Wild West needs to be compensated for too.. I remember reading a view that was so sensationalized.. 'the best movie ever' 'the best digital effects ever' 'the most entertaining movie this summer' 'if you see one film...' etc.. that it had to be that fake reviewer. This was around the same time period too.

I wonder how many people wasted their money on that crappy ass film because of the review.

Well that's good. It means you're only mostly worthless.
