I'm with you in that jail currently is a load of crap and is more detrimental than of any gain, but do you not think it would be wiser to consider other options other than your current thought trend which is:

1) Go to jail
2) Else, kill person.

I'd like to think of perhaps a third option. Something that isn't so draconian.

I'm not 100% sure what we're actually discussing. It actually started with wannabe 'ganstas' and appears to have moved on to psychologically disturbed young adults. The two being discrete and warranting different actions in order to punish/rectify their behaviors. I don't think some kid who smashes windows and steals cars should be put in the same set as a rapist/torturer/murderer.
