Caught my former employer forging a non-compete. Now what?

Did they use any pirated software at your old company? If so, report them to the BSA 🙂

They frequently did but I don't know why. The software was used on a regular basis as well.

In one instance I was even asked to download and install pirated software on a client server but I quietly ignored that request.
 
You should review your employment contract.
If the non compete isn't in there there should be a clause regarding (binding) arbitration between you and your former employer pertaining to contract disputes.


I have and it simply states in legal mumbo jumbo that I am their employee and that I could be terminated for any reason at anytime. And even that was not requested to be signed and sent back. I honestly believe that they realize the screw up and are flipping shits over it.
 
I just looked up the rating system because the last time I needed a lawyer was 7 years ago. They changed the rating system a bit and took out the CV mark probably because it didn't sound so great and replaced it with numbers. You can read the link to find out more on how the rating system works.

Destroy them. Lawyer, police, BSA/Microsoft, BBB, and the list goes on. Teach them that you should not have been trifled with. :awe:
 
You said you asked your former employer about the non-compete clause - did they ever get back to you? What was their response? If they can't provide it and they realize they've been caught, you need to demand they contact the vendor and provide a written apology, and whatever you feel is compensation for the loss in revenue. Tell them if they don't cooperate, you'll contact a lawyer in regards to slander and hold them liable for loss of revenue in court.

If all else fails, then go to the BSA and report them - warning though, this could go pretty serious for them. You'll be talking about a lot of money in fines and odds are they can be exposed. While you might feel it's a good idea, morally you might feel dirty because you'll ruin the lives of the owner along with any of his current employees.

F&ck him. Former boss would do this to him without a single thought if the shoe was on the other foot. Former boss shouldn't of started shit if he didn't want it in return.
 
You DID take their clients away from them. So, they lashed out at you with a dirty trick. This does not justify forging documents, but in their eyes, you are a cock sucker.

Yes, they screwed up by not being able to keep their customers - however, you know the type of scumbags you are dealing with here.

Move on and avoid them as best as possible.

Now, if you want to get cute, send them a professional photo of yourself with your signature reading; "You might as well have an authentic signature - here you go! All my best, XOXOXO. PS, next time you forge my signature, dot the I's with little hearts" - just be sure to dot your I's with little hearts.

OP you better do something. You said yourself it's a small market. This other company is trying to ruin you and if this goes unchecked how many other clients is he going to try this with or how many has happened and you don't know about it?

Well I just spoke to my lawyer and he said it would be extremely unlikely for them to produce the forged document. With the email from the vendor in hand that is still enough for the DA to charge them with third degree forgery. Then I could also file a suit seeking damages and that they would be likely to settle before it would reach trial.

My lawyer also added as a side note that my case is unique due to the vendor providing evidence against my employer. Otherwise these cases are not worth taking.
 
The solution partner called me and said that they were provided a copy of a non-compete with my signature stating that I was not allowed to compete in the same market as them.

They fucked up. Not normally one to rush to court, but take them to the cleaners. Otherwise you will face years of this crap.
 
Well, tell your lawyer to get the ball rolling on the legal case(s), and then go fellate the mods to get this thread wiped out, just in case.

I wonder how many threads return when googling Forged non-compete? By my count, it is now the 3rd result.

And how many more match up to his raise experience with his old employer? Or about the shared clients fiasco.
 
Right, but my point is, so what? He hasn't said or done anything damaging. And this thread can't be factually tied to any real-life situation, so that's an even bigger so what. So perhaps he's showing his hand a bit indicating he's pursuing legal action. If his story is accurate to this point, his employer is a complete moron... he wouldn't know what to do with that information (because there really isn't anything to do, for one thing) even if he happened upon it in the first place. This is tin foil hat area if you ask me.

So what type of badass lawyer did you go with? Does he have a good rating?

A BV (3.0). He is a bulldog and is a business owner himself so he understands what I'm going through. This is not going to be a cheap process but as with everything in life you get what you pay for.
