Careless driving for sliding into a ditch

Late Friday night (early Saturday) I was driving to a friend’s place right after a heavy rain storm, took a turn and my car hydroplaned into a deep ditch with large boulders in it; I was fine other than a bump on the head, but my car was in rough shape. I was already tired and in a grumpy mood and since it was not even two blocks from my friend’s apt I hiked it over there and spent the night.

After sun up I go to check out the car and found that it was gone! Called the Cops to see if they had it and they told me that someone reported it last night so they impounded it (F**K), and that an officer would contact me later to ask about it. Later that night an officer talked to me over the phone and told me that I’m required to report something like that since it’s considered an accident, and that he could charge me with hit and run but he was going to be “nice” and just charge me for careless driving (DOUBLE F**C).

Oh yeah, I’m also going out to Iraq in a few days as a contractor.

So Monday I get to pay to get my car back, see if it’s totaled or not (like I said, boulders jacked the car UP) and then show them my paperwork so I don’t have to deal with court until I get back in a year and try to get my agent to process it before I hop on a jet.

I love it! :-/

So you drive irresponsibly knowing the weather was foul (who doesn't once in a while), basically gamble and lose throwing your car into the ditch, then you abandon it and you blame the cops for giving you a ticket?

They're probably looking at it as, since the car hydroplaned on a wet road, you were probably exceeding the speed limit, as a slower car would not have lost control.

Leaving your car there overnight was a dumb idea. Should've called a tow truck yourself right away.

Awesome.

Yeah, it's understandable that they show up and say "Ok... So what happened here?!" and the least they could do is give me a ticket. It was my first accident, no one was involved, I was ok, it was on a side road that was out of the way and I didn't want to deal with it at the moment.

Chalk it up to inexperience; I'm more mad at the situation and not the cop.

Edit: Oh yeah, and if anyone asks, tell them the OEM tires on a Subaru Legacy suck in the rain.

OP, you're VERY lucky the cop doesn't give you a ticket for leaving the scene of an accident. That one can result in the loss/suspension of your license.
While sometimes, "shit happens" explains WHAT happened, failing to report it is 100&#37; on you.
As far as the cops are concerned, you might have been drunk at the time...which would explain why you didn't report it.
(I'm not saying that is the case, just the perspective from the cop's POV.)

This. You got into an accident, potentially totaled your car, and *could* have been hurt... and all you think is "Meh, I'll take care of it tomorrow"? Are you sure you didn't sustain some head trauma from the accident?

Look up the OEM tires on a 08 Legacy, they are HORRIBLE in the rain; I just got that car a few months ago (cert Pre-owned) and found that out the hard way. And yes, I wasn't thinking correctly before I got a lesson in physics because I was driving to see a friend of over eight years because I needed someone to talk to; hence why I just walked away from the car, I was already in a funk and was shaken up.

Like I said, chalk this up to inexperience.
