Car accident

Hey up all. We were in an accident last night with a kid that ran a red light. Our young - only a year old - car is looking rather sorry for itself, may be a right off, but if not it has certainly depreciated the value. This being my first accident can anyone give me any advice on what I should do.

Did you drive over a boy that was running over a street or some punk driving with a car?

ouch, i hope you took down his insurance information and called the police, especially since it wasn't your fault...good luck.

I hope you got his insurance and license info. Report to your insurance via phone and they'll usually appoint you with an atterny (ok i cant spell yet, just woke up) afterward to see if the other party's insurance will cover all your damages.

The kid (~17yo) was driving a maroon Dodge minivan so I assume it is his mothers.....
I called the police but they had already been called by one of the witnesses. The police took down everyones details and told me I was at 0% fault. However, everyone in our car is aching at the moment (and we did go to the hospital last night) and I am concerned that we have lost a lot of money on our car. :-( It is a 2001 Accord Coupe EX V6 with all the extras. No pics.

If you're at 0% fault, then you should have nothing to worry about. That punk and/or your insurance company should cover all cost of fixing the car.

If the car is a write off though, the insurance company will not give us a cheque for the cost to replace it, they will give us a cheque for two-thirds the value of the car because of depreciation.

Not true in my mom's situation. Some dumb b!tch piled into her minivan and Geico only covered 80 percent and the other insurance company didn't do sh!t because she was driving with a suspended license. My mom is still fighting to get the other 20 percent. :(

Mental trauma? No one is in the hospital or hurt that bad but you would sue for MENTAL trauma.

I agree... That's a bit too much... if i was the other person, and you pulled that on me.. you would be my #1 enemy for life.

Do not go to the auto body shop the insurance co. recomends !

Ask friends if they know of a good auto body shop, and take your car there.

You talk to your insurance company. If the car is a write off ( if damages = 80% or mroe of car's worth, then it will be a write off ) then and only then will you have to think about the $ part. If it is as bad as you say, and it is a write off, then you usually get replacement value, or what a car with the same milage and same condition could be bought for. Aftermarket items are usually not covered. (such as brush guards and the like )

If your car is fixed and the percieved value has gone down, then it may be time to contact a lawer. But frankly, I doubt anyone would take the case as no judge would concider the value of a wrecked and rebuilt car different from a unwrecked car. they see it as good as new unfortunately.

If you and yoru family is hurt, then it is time to get a lawer. The insurance and the driver ( and his family since the other driver is under contract age ) needs to cover any and all medical bills and lost wages. NO question. get you and the others in the car throughly checked out both by a doctor and a chyropractor ( or someone to make sure you have no tissure damage that may rear it's ugly head later )

IMHO, Lawers suck. only use one if it is absolutely neccessary.

Glad to hear that no one was seriously hurt. In the end, that is all that really matters.

You can also file a "Diminished Value" claim in many states. This reimburses you for the reduced cost of the vehicle when you eventually sell it or trade it in.

sue happy americans....bah(i'm american :D)

take the reparatiosn for your car and be done...i'm sure this kid has alot of mental trauma right now too
